  6. That was another great appellate court smackdown of an activist district court judge, Tina. From the decision –

The district court erred in granting that relief because the

grantees lack a cause of action to press their claims. They may

not bring a freestanding constitutional claim if the underlying

alleged violation and claimed authority are statutory. Nor do

the grantees have a cause of action under the APA because

APA review is precluded by the Impoundment Control Act

(ICA). And the grantees may not reframe this fundamentally

statutory dispute as an ultra vires claim either.

  7. That judges opinion is a mess. I know the freepassers said that trump stiffed the contractor. They were wrong. Gubment was paying but sought a delay. If there was a contract dispute, goes to the Federal court of claims. So. Wrong jurisdiction

The second issue was extending the future work which was canceled. No right there.

  9. An interesting observation about the president:

“Sund explained that there are several agencies working together to secure D.C. and highlighted that Trump is a “very, very detail-oriented person.”

“In case people don’t know that, it is not uncommon for him to be driving in a motorcade and realize, hey, street lights are out, or look at that or look at that graffiti and make a notification on it. That is how detail-oriented this President is. So for him to see some of the crime that’s happening and some of the assaults that are occurring — and Navy Yard is just six blocks south of the of the Capitol, short distance from the White House. It’s a big area,” he said.

“To see these gangs of youth kind of taking it over, it doesn’t surprise me that they’re now going to pull these federal resources together and form… [a] task force,” he said, explaining that they have done this before.”

  10. No doubt the Capitol was under protected.

piglosi purposely didn’t want those troops. They had minimal barriers and many capitol police were stupidly on leave.

Because fib and other assets were deployed on ground, they could have easily protected the Capitol.

That’s exactly what the majority wrote in their decision. You were right, Tina.

  20. PPI increase driven almost entirely by services inflation. Prices for final demand goods less foods and energy and for final demand energy moved up 0.4% and 0.9% respectively, which was less than analyst expectations.
