Garland is disappointed in the Fischer Decision. However, he might have more to worry about than Fischer, as the House continues to go after him for contempt. Trying to criminalize a protest will not bode well for Garland and others.

3:00 pm. Governor Youngkin will be there too, so my guess is, when they sense that Trump is about 30 minutes or so from being able to walk out on the platform, that’s when Youngkin will start to speak, and he will introduce Trump.

It is much more complex than that.
It is more about the difference between immunity for acts while in office versus a blanket immunity for criminal acts.
Presidents should have immunity for acts while in office to prevent a Bunu for suing him for ordering terrorists killed, or even for a mistake like ordering a military operation that goes wrong like for example Carter’s Iranian hostage debacle.
In my view, Trump should have immunity from criminal prosecution for any acts relating to Jan 6 while in office.

It was a very narrow interpretation of a statute. Essentially, the individual took part in the protest that was intended to stop certification of the election. Trying to stop certifying the election was obstructing the process. I think all Judges are susceptible to to looking at an issue as an intellectual exercise than just looking at the result.

I think the immunity decision is going to recognize a degree of immunity but not complete. For example, a President should not be sued or prosecuted for a crime for ordering a military operation that leads to deaths of troops or enemies but if a President shoots somebody in the head because they pissed him off, that is not an official act.
