Bitter is absolutely correct. The time I was on a jury years ago, the judge was viewed as our advocate and protector. He routinely stopped everything to instruct us, and answer our questions, and then even when it was all over, he spoke once more thanking us for our service.

The way Merchan wrote and delivered jury instructions was like a one-way ramp facilitating a conviction from the jury. If such a conviction happens this biased judge can then decide to incarcerate Trump pending his appeal. Mission accomplished by the crooked Dems by taking the leading opponent out of competition.

I know I’ve posted multiple times about these jury instructions. But, I’m just flabbergasted at the gross biased injustice going on in Merchan’s courtroom. I don’t care what political bent any defendant is, this type of judicial manipulation of a court proceeding should not be allowed to stand!

It is unlikely even this judge will put Trump in jail. The maximum sentence for this “crime” is 4 years but Trump as a first time offender would be unlikely to be sentenced to jail, and in any case it would be unlikely he wouldn’t be free pending appeal.

CNN says Trump only getting 8% of the over 55 black vote, but an astounding 27% of the 18-55 black vote. Not black men, black voters, which would mean he is getting over 30% of the younger black men vote.
According to them, that would be enough to flip PA, WI, AZ and GA just on that vote.

He told the jury they could vote guilty on either 53 counts or 54 counts, their choice, but 54 looked better because it showed “unanimous”.

Bitter, please correct me, but if I recall the process of jury questions during deliberations, these are things only the judge can answer, and they do not hear again from the prosecution or the defense.
And so these questions put to the judge will be answered freely with a slant toward conviction no doubt.

They asked for a lot of the Pecker testimony (let the jokes begin). I don’t recall if it was damning for Trump or not, but they also asked for the jury instructions to be read again.

DW – It has been years since I had a civil jury trial. I never handled criminal cases. That said, I believe the jury can request that testimony from a witness be read to them. I think both sides are present during that but not allowed to speak or interfere.

what is abundantly obvious is that the first jury straw poll was not unanimous in either direction, and upon pushing, there was not any immediate budging.
I recall when I was on a 12 person jury, the first straw vote was 3 to convict, 9 to acquit. The slightest push, and two men said yeah, I think he did it and suddenly it was 5 to 7. It took another 8 hours or so, but I eventually got it to 12-0 and we put the guy away for 30 years

I wish I could tell you that jurors are smart. Many are not. I recall one young woman who was pushing for not guilty because nobody should ever be found guilty unless there was a video camera filming the accused committing the crime. I asked her how anyone was guilty prior to the 1980s when camcorders became more common, and she said, “oh, I didn’t think of that!”

I was on a traffic violation jury in Texas. The guy was clocked at 77 in a 15 mph school zone. I was the only one who thought he should be convicted, everyone else said yeah he is guilty but we don’t like speed traps we aren’t going to convict. I had better things to do than to argue with 11 other people so I voted with them. I could have held out, but that would have taken hours and the result would have been the same, he would have walked and the case never retried. Maybe DW could have swayed them if he turned a 9-3 vote around.

I remember well the final holdout, a middle-aged woman. Finally she leaned back and looked up at us and said, yeah, he did it. I just don’t want to put him away for life. But she reluctantly agreed. Much to her surprise and delight, after the verdict was given, the judge held us back after the courtroom was emptied, to tell us that the defendant had a long list of firearms violations and prior convictions, but we weren’t allowed to know that given he was on trial for one specific crime. There was a great deal of relief among many of the jurors that we took a danger out of society.

When jury trials are not politically motivated circuses like this Trump sham of a trial, most are settled without actually going to the jury. In fact the most common misconception of jurors is they think their case will be easy and open/shut. But those are exactly the ones that almost never make it to the jury. They go to jury because the both the prosecution and defense think they can win.
