In order to assure the absence of such a motivation, we have concluded that, whenever a judge imposes a more severe sentence upon a defendant after a new trial, the reasons for his doing so must affirmatively appear. Those reasons must be based upon objective information concerning identifiable conduct on the part of the defendant occurring AFTER the time of the original sentencing proceeding. And the factual data upon which the increased sentence is based must be made part of the record, so that the constitutional legitimacy of the increased sentence may be fully reviewed on appeal.” That is what happened to Little. Judge Lamberth went through a series of facts involving Little that happened AFTER the first sentencing. For a J6 defendant to be resentenced to more time after a successful appeal, the Judge would have to identify something the defendant did AFTER the original sentencing that warranted a different sentence. Imposing a longer sentence as retribution for having successfully appealed is a violation of the Due Process clause of the Fifth Amendment.

He is a piker compared to Menendez.
Expelling him was probably one of the stupidest moves the GOP could ever have made, and that has a lot of competition.

I agree with Jason. There is only downside to getting rid of him. It is making it harder to lead over the next 8 months until the election. We knew the seat was gone once he left, just as it would have been in November, but at least it is another year it would have stayed with someone voting Republican, at least most of the time. Geez. now Santos is running again, as an independent, for the same seat.
We love to lose.

No, Santos is now running as an Independent in a different Congressional district. The Republican incumbent was one his biggest enemies. It all but guarantees the seat will go to a Democrat.

Funny fact about Hoover, in 1920 they were trying to recruit him to run for President, and both the Dems and Republicans were after him, much like Eisenhower 32 years later.
Wish Hoover had chosen the D side. He ruined the Republican party’s chances for the next twenty years. Though, unlike popular culture teaches us, FDR’s alphabet soup programs and foray into socialism did not end the depression…WWII did that.

Given the prior Susquehanna poll of PA was Trump 39/ Biden 47 I will predict this one will be Trump 45 / Biden 48. Nothing really has changed in the race since January, so if they use the same methodology and weightings, the final results they get probably won’t move much unless they had a really wild outlier last time.
