I used to listen and liked Hugh Hewitt, especially when he was broadcasting out of S. CA. However, when he moved East, to the DC area, in order to cover the beltway better, he became part of the beltway.

I don’t think SCOTUS is going to decide the issue now. It does not issue advisory opinions and because there is no case or controversy until a verdict is rendered, it may sit out for now. Of course, it could decide this is similar to the Watergate tapes and make a ruling.
Why would the sc need to make this decision quickly? Why couldn’t the appeals court take a stab at it first?

That SCOTUS has asked Trump’s team to respond to SCO Smith’s motion is not surprising.
If Trump agreed, the Court might take it up on an expedited basis IF it intended to take it up. The Court would still set the briefing schedule.
It’s tantamount to both sides simply saying “There is no reason for a stop at the Court of Appeals because whoever loses there is going to SCOTUS next.”
But if Trump objects to an expedited basis — which I presume he will — the Court could refuse to take it up now and instead allow the matter to be dealt with by the Circuit first; the Court could take it up and set whatever schedule works for the court; or the Court could take it up on an expedited basis.
But I don’t see any of the three outcomes saving a trial date that is only 80 days away.

The Nixon case skipped over the Appeals Court and had SCOTUS settle the disputed issue without further delay.
SCO Smith has not only asked for that — which is discretionary — he has also asked for an expedited schedule rather than have the matter proceed under normal scheduling and briefing practices which would mean months of preparation prior to an oral argument.
That was also done in the Nixon case so the SCO Smith fans are claiming the same should be done to Trump.
Here are a few problems:
Pres. Nixon was not on trial. The Nixon case was litigation over whether Nixon had to comply with a subpoena for records — the tape recordings of his office meetings. Nixon’s attorneys moved to quash the subpoena, but lost in the trial court in late May 1974.
The subpoena was for use of the records at trial — the trial was United States v. Mitchell, involving the 7 Nixon aides charged in connection with the Watergate break-in. The trial was set for Sept. 1974.
At issue was the trial rights and due process rights of those 7 defendants. The defendants wanted access to the tapes just as Special Prosecutor Jaworski wanted access to the tapes. Nixon asserted “Executive Privilege” and refused to produce them for use at trial. The Mitchell case had already been indicted when the subpoena and motion to quash were litigated.
After Nixon filed an appeal in the D.C. Circuit — BOTH SIDES filed separate petitions for “Cert before Judgement” asking SCOTUS to take up the case on under the same rule that SCO Smith is trying to use. So there was no purpose in briefing whether that was an appropriate step since both wanted it.
Because trial in the Mitchell matter was only 3 months away — the speedy trial rights of the defendants in that pending case were implicated — SCOTUS set it on an expedited basis AFTER its calendar for the 1973-1974 term had already ended. The Cert petitions were filed late May 1974, briefs were filed in June 1974, and oral argument was held on July 8, 1974 — after the Court was done with its other work for that year.
The decision was 8-0 against Nixon — Justice Rehnquist did not participate since he was in the Nixon DOJ at the time of the events in question.
There was only one opinion, written by Chief Justice Berger. There were no dissents and no concurring opinions.
Even with all that, the decision wasn’t announced until July 24, 1974.
So this expedited process, with both sides agreeing, on a narrow issue of “Executive Privilege” when the due process rights of defendants on trial was at issue, still took nearly 60 days from start to finish — at a time when SCOTUS had finished its other work for the year, and the outcome was 8-0 with no Justice other than the Chief writing an opinion.
So, ignore all the folks holding up U.S. v. Nixon as a reason to think SCO Smith can accomplish his goal of keeping the March 4 trial date — now only 82 days away.

No one knows where all our aid is going. The military is no longer with Zelensky, as are the Ukrainian people who are fleeing Ukraine rather than fighting for it. The keynote speaker at my daughters graduation (4.0 GPA) at Arizona State University today told a story of him and his friends meeting a little known one term Governor from Georgia and his wife on campus a couple months before the 1976 Iowa Caucuses. There were only a half dozen students to meet Jimmy Carter in a small auditorium during a campaign stop at the University of Iowa. Jimmy asked if the students could help drive them around the state. One of them volunteered and ended up working at the White House. Great story.
I don’t understand why Iowa and New Hampshire are always the first 2 states to vote. They are very small and unique in their demographics. I think states like Ohio, Pennsylvania, New Mexico and Virginia would be more relevant early on.

MASSIVE news out of the Supreme Court this morning.
The Court will hear Fischer v. United States, a January 6 case challenging the scope of section 1512(c)(2), which criminalizes obstruction of an official proceeding. Two of the four charges President Trump faces in his DC case involve 1512(c)(2).
That section, first passed as part of Sarbanes-Oxley in 2004, has typically been used to prosecute destruction of evidence or similar conduct. Its applicability to alleged obstruction of the electoral count process has been hotly contested since the start of the January 6 prosecutions, and the DC Circuit split sharply on the issue.
This is a huge deal, with potentially major ramifications for many January 6 defendants as well as for President Trump.
Unlike you Jason, Carlson self corrects when he sees he has had the wrong take on an issue. He doesn’t continue to mishandle the truth just to keep his ego intact.

I’ve always been of the view that SCOTUS would likely take this up because it is a sideways way it can deal with the issue relative to Trump without having to take it up directly as Trump’s case. The latter would be fraught with political overtones whereas doing it this way resolves the issue without Trump’s direct involvement.

Some very seasoned and smart attorneys on the liberal side of the spectrum allowed their personal and partisan desires to cloud objective judgments on “nuts and bolts” issues of federal criminal procedure.
They were Captain Ahab and having a trial in the spring of 2024 was their “White Whale.”
There were always many opportunities for Trump to derail the trial schedule, and he has now done so. I think the
Trump defense played this exactly correctly — they complained about the trial schedule so they had a record of having done so. They then went about trying to comply with the deadlines with some unstated confidence that the schedule would eventually crash upon the rocks of pretrial issues that would cause delays.
The decision by SCOTUS this morning to take up the challenge to Sec. 1512 — with 2 of the 4 counts charged against Trump being connected to that charge — was the final straw. There is no reason now for SCOTUS to expedite the appeal of the immunity issue. While the cases are different, both will have a huge impact on what happens with the DC case if/when it ever gets to trial. So SCOTUS can deal with both on parallel tracks with similar schedules.
Oral arguments at the end of April and decisions at the end of June is the most likely result.
THEN an entirely new scheduling order will be necessary in the case — if there still is a case.
That new schedule will bump up against the FL case which I expect will be reset for mid-to-late summer.
The issue will be whether the DC case will be set in the fall of 2024 during the middle of the general election campaign.
My guess would be — “No.”

I don’t try to project how this whole election is going to shake out, as it could easily go sideways for any of the candidates including Trump. I also do not use the word “grifters” lightly, especially on people like Julie Kelly (a steadfast one-woman advocate for the J6 prisoners and their families), Bannon (a serious politically savvy historian), and Jack Posobiec (a smart worldly Intel officer who doesn’t bs people). The last two men are “devout” Trump supporters who tell it like they see it- much like Tucker Carlson. When you talk about”false narratives” it would have more validity if you offered examples rather than just rattle off generalities, as a way to scorn people, in lieu of RDS’s campaign doing so poorly. It sounds more like sour grapes, JeffP, than a substantial criticism of those surrounding an opponent of your guy.

I don’t think SCOTUS is going to decide the issue now. It does not issue advisory opinions and because there is no case or controversy until a verdict is rendered, it may sit out for now. Of course, it could decide this is similar to the Watergate tapes and make a ruling.

That SCOTUS has asked Trump’s team to respond to SCO Smith’s motion is not surprising.
If Trump agreed, the Court might take it up on an expedited basis IF it intended to take it up. The Court would still set the briefing schedule.
It’s tantamount to both sides simply saying “There is no reason for a stop at the Court of Appeals because whoever loses there is going to SCOTUS next.”
But if Trump objects to an expedited basis — which I presume he will — the Court could refuse to take it up now and instead allow the matter to be dealt with by the Circuit first; the Court could take it up and set whatever schedule works for the court; or the Court could take it up on an expedited basis.
But I don’t see any of the three outcomes saving a trial date that is only 80 days away.

You are likely to see lefty legal beagles claiming today that SCOTUS should treat the Trump case just like it treated U.S. v. Nixon in 1974, where the Court accepted the case on an application for “Cert Before Judgment” at the appellate level.
The Nixon case skipped over the Appeals Court and had SCOTUS settle the disputed issue without further delay.
SCO Smith has not only asked for that — which is discretionary — he has also asked for an expedited schedule rather than have the matter proceed under normal scheduling and briefing practices which would mean months of preparation prior to an oral argument.
That was also done in the Nixon case so the SCO Smith fans are claiming the same should be done to Trump.
Here are a few problems:
Pres. Nixon was not on trial. The Nixon case was litigation over whether Nixon had to comply with a subpoena for records — the tape recordings of his office meetings. Nixon’s attorneys moved to quash the subpoena, but lost in the trial court in late May 1974.
The subpoena was for use of the records at trial — the trial was United States v. Mitchell, involving the 7 Nixon aides charged in connection with the Watergate break-in. The trial was set for Sept. 1974.
At issue was the trial rights and due process rights of those 7 defendants. The defendants wanted access to the tapes just as Special Prosecutor Jaworski wanted access to the tapes. Nixon asserted “Executive Privilege” and refused to produce them for use at trial. The Mitchell case had already been indicted when the subpoena and motion to quash were litigated.
After Nixon filed an appeal in the D.C. Circuit — BOTH SIDES filed separate petitions for “Cert before Judgement” asking SCOTUS to take up the case on under the same rule that SCO Smith is trying to use. So there was no purpose in briefing whether that was an appropriate step since both wanted it.
Because trial in the Mitchell matter was only 3 months away — the speedy trial rights of the defendants in that pending case were implicated — SCOTUS set it on an expedited basis AFTER its calendar for the 1973-1974 term had already ended. The Cert petitions were filed late May 1974, briefs were filed in June 1974, and oral argument was held on July 8, 1974 — after the Court was done with its other work for that year.
The decision was 8-0 against Nixon — Justice Rehnquist did not participate since he was in the Nixon DOJ at the time of the events in question.
There was only one opinion, written by Chief Justice Berger. There were no dissents and no concurring opinions.
Even with all that, the decision wasn’t announced until July 24, 1974.
So this expedited process, with both sides agreeing, on a narrow issue of “Executive Privilege” when the due process rights of defendants on trial was at issue, still took nearly 60 days from start to finish — at a time when SCOTUS had finished its other work for the year, and the outcome was 8-0 with no Justice other than the Chief writing an opinion.
So, ignore all the folks holding up U.S. v. Nixon as a reason to think SCO Smith can accomplish his goal of keeping the March 4 trial date — now only 82 days away.

No one knows where all our aid is going. The military is no longer with Zelensky, as are the Ukrainian people who are fleeing Ukraine rather than fighting for it. Winter has set in making it more difficult to maintain front line fighting forces. And, Russia is only being helped by making future negotiations less advantageous for the Ukrainians, because of elongating the war way beyond their capacity to successfully fight it. Fundamentally, war enablers are only aiding and abetting more death and destruction and making Putin stronger.

The keynote speaker at my daughters graduation (4.0 GPA) at Arizona State University today told a story of him and his friends meeting a little known one term Governor from Georgia and his wife on campus a couple months before the 1976 Iowa Caucuses. There were only a half dozen students to meet Jimmy Carter in a small auditorium during a campaign stop at the University of Iowa. Jimmy asked if the students could help drive them around the state. One of them volunteered and ended up working at the White House. Great story.

I don’t understand why Iowa and New Hampshire are always the first 2 states to vote. They are very small and unique in their demographics. I think states like Ohio, Pennsylvania, New Mexico and Virginia would be more relevant early on.

This is felony used against 300+ J6ers and represents half of Jack Smith’s indictment against Trump.
If SCOTUS determines DOJ has misused the statute…will be a game changer.

Tucker Carlson is launching his own web site where corporations won’t be able to cancel news or a POV which counters the government’s narrative or distorted version of the truth. His platform will only be the 2nd one I will be subscribing to. Rarely, though, does someone appear on the public stage who is governed by an honest take on domestic and world issues, rather than grifting off the good old boys club of political correctness.

New law being proposed in the People’s Republic of Washington State, where the communist government will be allowed to use gas leaf blowers, as needed, but the serfs who live in the state will be thrown into jail for a year if caught using these environment destroying machines.
Meanwhile, outside of the USA, the rest of the 94% of the world population, they don’t care a bit about such foolishness, and will gleefully accept our stupidity to our own detriment and their advancement.

Here in one S CA community gas leaf blowers have been banned for years (with fines if one goes against this law), while city gardeners seem to use them without any repercussions. It’s really a lopsided game of rules and protocols when living in a progressively run enclave.

MASSIVE news out of the Supreme Court this morning.
The Court will hear Fischer v. United States, a January 6 case challenging the scope of section 1512(c)(2), which criminalizes obstruction of an official proceeding. Two of the four charges President Trump faces in his DC case involve 1512(c)(2).
That section, first passed as part of Sarbanes-Oxley in 2004, has typically been used to prosecute destruction of evidence or similar conduct. Its applicability to alleged obstruction of the electoral count process has been hotly contested since the start of the January 6 prosecutions, and the DC Circuit split sharply on the issue.
This is a huge deal, with potentially major ramifications for many January 6 defendants as well as for President Trump.

The decision by SCOTUS today to take up the appeal on the 1512 “obstruction of an official proceeding” case means the Trump DC case will not be going to trial. This is the easy way to make that happen without directly acting on the Trump case on an expedited basis.

I’ve always been of the view that SCOTUS would likely take this up because it is a sideways way it can deal with the issue relative to Trump without having to take it up directly as Trump’s case. The latter would be fraught with political overtones whereas doing it this way resolves the issue without Trump’s direct involvement.

I learned back then to not put much stock in MAGA grifters like Julie Kelly, Bannon, Posobiec, etc…even though they might “get” some things… they are not objective, wrong all of the time, promoted false narratives for Trump and are unaccountable to their devout followers.

The Trump DC Case has just been stayed by the Judge due to the appeal of the immunity issue.
March trial date and all filing deadlines are all canceled pending the outcome of the appeal.

Some very seasoned and smart attorneys on the liberal side of the spectrum allowed their personal and partisan desires to cloud objective judgments on “nuts and bolts” issues of federal criminal procedure.
They were Captain Ahab and having a trial in the spring of 2024 was their “White Whale.”
There were always many opportunities for Trump to derail the trial schedule, and he has now done so. I think the
Trump defense played this exactly correctly — they complained about the trial schedule so they had a record of having done so. They then went about trying to comply with the deadlines with some unstated confidence that the schedule would eventually crash upon the rocks of pretrial issues that would cause delays.
The decision by SCOTUS this morning to take up the challenge to Sec. 1512 — with 2 of the 4 counts charged against Trump being connected to that charge — was the final straw. There is no reason now for SCOTUS to expedite the appeal of the immunity issue. While the cases are different, both will have a huge impact on what happens with the DC case if/when it ever gets to trial. So SCOTUS can deal with both on parallel tracks with similar schedules.
Oral arguments at the end of April and decisions at the end of June is the most likely result.
THEN an entirely new scheduling order will be necessary in the case — if there still is a case.
That new schedule will bump up against the FL case which I expect will be reset for mid-to-late summer.
The issue will be whether the DC case will be set in the fall of 2024 during the middle of the general election campaign.
My guess would be — “No.”

The dc case appears very weak. How can a non participant even be charged with 1512(c)? This assumes that one reads it is a favorable light.

I don’t try to project how this whole election is going to shake out, as it could easily go sideways for any of the candidates including Trump. I also do not use the word “grifters” lightly, especially on people like Julie Kelly (a steadfast one-woman advocate for the J6 prisoners and their families), Bannon (a serious politically savvy historian), and Jack Posobiec (a smart worldly Intel officer who doesn’t bs people). The last two men are “devout” Trump supporters who tell it like they see it- much like Tucker Carlson. When you talk about”false narratives” it would have more validity if you offered examples rather than just rattle off generalities, as a way to scorn people, in lieu of RDS’s campaign doing so poorly. It sounds more like sour grapes, JeffP, than a substantial criticism of those surrounding an opponent of your guy.

Right now in Iowa Trump is having another session with Caucus participants. It’s a small venue having lines of people waiting to get in. These packed sessions along with the current polling is indicating better optics for DJT than RDS. All RDS can do is lead with a false narrative, that has already been debunked, insinuating Trump being associated with a satanic religious group.
Impeachment hearings passed.
