Having an unknown virus to understand and instantly create protocols for, as a hostile press, political peers and others watched, criticizing every comment and move Trump made, was challenging, to say the least. Now that everyone has a clear rear view mirror to ascertain what went wrong, they can play Monday morning quarterback, sounding so smart. However, when decisions are made in real-time the path forward is not always smooth, or absent flawed decision making. Yes, Fauci should have been fired, but Trump would have been unmercifully attacked, even by some members of HHR. When Scott Atlas was added to the task force by Trump the mix of Fauci/Birx/Atlas did not play well. Read Dr. Atlas’s book sometime detailing the interactions in this task force and Trump’s leadership in it.

    IMO, few could have managed so many crises as well as Trump did that year, including not overreaching his presidential powers, and leaving it to state governors to determine their own pandemic rules (like DeSantis) and 2020 summer riot controls. The final note in December 2020, though, was a country rebounding, with remarkable border security, energy independence, less than 2% inflation, and then came Biden’s EOs in January 2021 turning everything south.

    I agree with Bitter. I am not letting Trump off the hook. Fauci led him by the nose into bad decision-making, such as lockdowns. The Trump presidency was a failure as far as sane coronavirus policy.

    If you look at the HHR board during the epidemic, I was one of those strongly advocating for taking the Swedish approach — no lockdowns. The Trump administration never even considered it. In addition Trump spoke in defense of China. Frankly, Trump became Fauci’s poodle:

  64. Unfortunately, Trump is right. There will be no fair trial in DC with that jury pool and certainly not with this judge. The venue was the reason such a case was even brought up in the first place. Jonathon Turley has stated it’s a crap case but that Trump will probably be convicted in that venue and that the verdict will almost certainly be reversed on appeal. The plan is to time it such that they get a conviction just before the election (talk about election interference) and then the Biden Justice Dept won’t even care the verdict will be thrown out because the conviction will have already served its purpose at election time.

    Of course, Republicans could completely blow up the Democrats entire plan by just nominating DeSantis and then it wouldn’t matter but then that would require some strategic planning that’s entirely nonexistent in the party of stupid.

    While we can bicker with the whether it’s wise strategy for Trump to publicly say what he said about the judge, it won’t matter one way or the other. The timing and script for this trial has already been cast int stone.

  123. This is freaking crazy. A portion of the Eastman memo for January 6th plan to give Trump election. This is what Pence was pressured to participate in.

    1. VP Pence, presiding over the joint session (or Senate Pro Tempore Grassley, if Pence recuses himself), begins to open and count the ballots, starting with Alabama (without conceding that the procedure, specified by the Electoral Count Act, of going through the States alphabetically is required).

    2. When he gets to Arizona, he announces that he has multiple slates of electors, and so is going to defer decision on that until finishing the other States. This would be the first break with the procedure set out in the Act.

    3. At the end, he announces that because of the ongoing disputes in the 7 States, there are no electors that can be deemed validly appointed in those States. That means the total number of “electors appointed” – the language of the 12th Amendment — is 454. This reading of the 12th Amendment has also been advanced by Harvard Law Professor Laurence Tribe (here). A “majority of the electors appointed” would therefore be 228. There are at this point 232 votes for Trump, 222 votes for Biden. Pence then gavels President Trump as re-elected.

    4. Howls, of course, from the Democrats, who now claim, contrary to Tribe’s prior position, that 270 is required. So Pence says, fine. Pursuant to the 12th Amendment, no candidate has achieved the necessary majority. That sends the matter to the House, where the “the votes shall be taken by states, the representation from each state having one vote . . . .” Republicans currently control 26 of the state delegations, the bare majority needed to win that vote. President Trump is re-elected there as well.

    5. One last piece. Assuming the Electoral Count Act pro Assuming the Electoral Count Act process is followed and, upon getting the objections to the Arizona slates, the two houses break into their separate chambers, we should not allow the Electoral Count Act constraint on debate to control. That would mean that a prior legislature was determining the rules of the present one — a constitutional no-no (as Tribe has forcefully argued). So someone – Ted Cruz, Rand Paul, etc. – should demand normal rules (which includes the filibuster). That creates a stalemate that would give the state legislatures more time to weigh in to formally support the alternate slate of electors, if they had not already done so.

    6. The main thing here is that Pence should do this without asking for permission – either from a vote of the joint session or from the Court. Let the other side challenge his actions in court, where Tribe (who in 2001 conceded the President of the Senate might be in charge of counting the votes) and others who would press a lawsuit would have their past position — that these are non-justiciable political questions – thrown back at them, to get the lawsuit dismissed. The fact is that the Constitution assigns this power to the Vice President as the ultimate arbiter. We should take all of our actions with that in mind.

    Individual Republican lawmakers in the House (and Senate?) were prepared to make arguments during the count concerning various irregularities in the various states where Biden narrowly won (PA, MI, WI, AZ, NV GA) and raise valid points about election laws in those various states not being followed or overridden by state courts that unconstitutionally usurped election powers.

    This would force the real issues of election laws not being followed in the various key states and highlight valid concerns over other election issues (such as mail in ballot that came in after the legislated deadline date in PA and others, mail in ballots with no signatures, mail in ballots with very questionable signatures or that don’t come close to matching what is on file, absentee votes cast by someone who was not the real voter, thousands of voters in NV who were also registered voters in CA, people who moved out of the key states months or years before but still somehow “cast” ballots in those states, 135 ballots being cast where the residence is actually a vacant field, ballots “cast” by people on the VR list who are 135 years old or older, votes by people who were not legal residents of the U.S., etc.

    The Dems knew that such data being thrown out to the TV networks print media and American people during the floor session would indeed raise serious questions about the validity of the election and cast serious doubt as to whether or not Biden actually DID win those key states. SO THE DEMS HAD TO PREVENT THE WHOLE COUNTRY BEING INFORMED OF THESE “VOTING IRREGULARITIES” IF THE ELECTORAL COUNT DID TAKE PLACE ON JAN. 6TH.

    There was a story a military officer in the Pacific theater telling his men that President Truman just saved their lives. The invasion was expected to result in about a million U.S. casualties.

I remember a number of comments from Trump after J6, where Pence did his mea culpa, pleading his reason for turning away state’s requests for further time to analyze the votes was because of his need to follow the Constitution, was met by Trump as he is a good person type of response.     To an extent its foreign influenced, but it also reflects a weakening of the American character that has taken place.

    There always will be a category of people who want to swoon over foreign dictators. They feel uncomfortable in a democracy with all its controversy and limitations. Prior to World War II there was a strong pro-Nazi movement in the U.S., which had marches with individual giving the Nazi salute. There were also those who admires Stalin and communism, while ignoring its atrocities.

    The New York Times totally ignore Stalin’s deliberate actions in starving the Ukrainian people — instead it published glowing stories about how much factory employment there was in the Soviet Union.

    Frankly I consider a lot of the problems now are a result of President Obama, who was actually more favorable to Putin than Trump was. When Putin invaded the Republic of Georgia, Obama did nothing, an actually sent a U.S. troops contingent to march in a Moscow military parade.

    Then there was the debate between Obama and Romney when Obama said: “The 1970s are now calling to ask for their foreign policy back because the Cold War has been over for 20 years.”

    Or when Obama got caught on a hot mic telling the Russian President he would have “more flexibility after the election.” It was Obama who opened the door for Putin’s aggression. Underneath, leftist Obama loathed his country, and had no problem undercutting it’s strength and determination.

    I definitely believe Joe Biden’s attempt to threaten and manipulate the Freedom of the Press/First Amendment might be an impeachable offense. (see below)
