I think they have a good case against Comey on count 1 IF they can prove he did the shell design. I don’t know how they do that unless they have a witness who saw him do it, very possible on a public beach.
Count 2 is clear, he certainly posted it. Will a jury believe him that he “didn’t know what it meant” although he “thought it was political. Proving to the jury beyond a reasonable doubt that he knew it was a threat to the President will not be easy.
I don’t think anyone, even the most ardent Marxists, believe Comey found those shells like that. The jury won’t either, and the defense might damage his case by pretending he did. Their best shot is hey, he was just screwing around, there was no malicious intent beyond his opposition to the President.

They can use many references such as Matt Gaetz tweet: “We’ve now 86’d: McCarthy. McDaniel. McConnell. Better days are ahead for the Republican Party”. Prior to mid-2025, the majority of times the term “86” was used it did not reference violence.

I read the indictment, there is no case whatsoever on the 8647 thing. It won’t go anywhere. The use of 86 before mid 2025 was typically not a ‘threat’.

No, this is not even close to being retribution.
Retribution would be to pick some imaginary action Comey took against Trump when he was FBI Director, not that they would have to invent anything.
In this case, Comey could have faded into the sunset. He could have resigned himself that all his mostly illegal and partisan actions against Trump failed.
But instead he couldn’t accept his irrelevance. He chose to post something that could be interpreted as a threat to President, amplified by his status as a former high level official.
It is exactly the thing that would inspire crackpots like the one who shot up the correspondent’s dinner.
It is not a distraction at all. It is actually perfect timing .

Someone could say I feel like going out and killing somebody. But if that persons says they feel like killing the President and post that online it’s a very different animal.
Comey is guilty as hell. I doubt there won’t be a trial. Whether he gets convicted depends on how convincing the prosecution is on proving intent.

Jason is making my point. Clearly, 86 has nothing to do with killing the president. And it mostly had the connotation of removing something just as the example of Matt Gaetz.
Even if the meaning could be interpreted as violent, it is still protected hypobolic speech. There is no evidence that this rising to the level of a true threat in any way possible.
