I read articles dealing with how the war is going – the brutal conscription process of grabbing young men who don’t want to fight; taking people who are 60 years old to fight on the front lines; the continuing graft and government corruption; the authoritarian way the government treats it’s people. These are factors you ignore while waving poms poms for more war, more death. It’s sad you can’t see the futile suffering going on in the midst of your zeal to “win” at any cost. I don’t see that as a humane way to see this war.

    Observation on a “new” census:

The Constitution reads as follows: “The actual Enumeration shall be made within three Years after the first Meeting of the Congress of the United States, and within every subsequent Term of ten Years, in such Manner as they shall by Law direct.”

If a Census is taken “Year 3”, what is “within every subsequence Term of ten years”? Seems to me than answer is “Years 4, 5, 6, 7, 8, 9, 10, 11, 12, and 13. The Constitution does not mandate a 10 year gap between the taking of censuses — it says 10 years as the maximum permissible time between taking censuses.

    Thank you for your attention.

  41. It is too bad that contributors to this site (and the President) don’t do a bit of reading before opining on what the laws are.

The Constitution states: “The actual Enumeration shall be made within three Years after
the first Meeting of the Congress of the United States, and within every subsequent Term
of ten Years, in such Manner as they shall by Law direct.”

Congress has, indeed passed laws to direct how the decennial census is to be conducted. Here are the relevant sentences from US Code, Title 13:

“The Secretary shall, in the year 1980 and every 10 years thereafter, take a decennial census of population as of the first day of April of such year, which date shall be known as the “decennial census date”, in such form and content as he may determine, including the use of sampling procedures and special surveys.”

Not much room for debate about this one. Every ten years after 1980 includes the years 1990, 2000, 2010, 2020, and 2030. It does not include the year 2025 or 2026.

  44. And yes, the 2020 census was screwed up. Covid made it impossible to do the canvassing that the law requires, and only about two-thirds of the mail-in census forms were returned. So estimates replaced the actual enumeration demanded by the Constitution.

One result it that California, New York, and Rhode Island ‘counted’ much larger populations than the previous Census Bureau estimates. This alone cost the Republicans 4-5 seats in the House in 2022 and 2024.

Those with good memories may recall that Trump spent a year of the time when the Census Bureau should have preparing for the decennial arguing that non-citizens should be excluded from the 2020 count. He is repeating that mistake this summer.

  62. Judge Rao slams Boso:

Judge Neomi Rao did not hold back in her criticism of Jeb Boasberg’s contempt order. Noting his underlying temp restraining order banning removal of Alien Enemies Act subjects had been overturned by SCOTUS, Rao (and Judge Katsas) accused Boasberg of attempting an end-around SCOTUS by pursuing criminal contempt charges unless Trump DOJ complied with his vacated order. WILD. Rao: “The district court’s order is a ‘clear abuse of discretion’ that warrants the ‘drastic and extraordinary remedy’ of mandamus.

When an injunction [the temp restraining order] has been vacated, as occurred here, a district court loses the authority to coerce compliance with the order. Punishment through criminal contempt might still be available in these circumstances, but the district court cannot use the threat of such punishment as a backdoor to obtain compliance with a vacated and therefore unenforceable TRO.

The district court’s abuse of the contempt power is especially egregious because contempt proceedings against senior Executive Branch officials carry profound ‘separation of power[s] overtones’ that demand the most ‘sensitive judicial scrutiny.’ Lacking the authority to compel obedience, the district court nonetheless pressured the government to take custody of alleged alien enemies held in El Salvador. This intrusion on the President’s foreign affairs authority ‘constitute[s] an unwarranted impairment of another branch in the performance of its constitutional duties.’
Because the order exceeds the court’s authority and amounts to a clear abuse of discretion, mandamus is appropriate.”

Haven’t heard Trump, or Stephen Miller, who I see mainly pushing this census, say that it will be used to apportion Congress.

That said, it can and will most probably be used in a political manner, as they will not count illegal immigrants in this census, so moving forward they will be able to show in some manner the affect on public services and the extent to which illegal immigrants have impacted the safety net designed for American citizens, along with giving certain sanctuary states more representative power than they deserve.

The decennial census is very expensive both in labor and equipment, so I don’t really favor one mid-decade, especially since it won’t be used for congressional apportionment.

You don’t need a census to show the cost of illegals to public services, so I think this is just grandstanding and a waste of money.
