“In a significant ruling with constitutional implications, a three-judge panel on the U.S. Court of International Trade has struck down a broad set of tariffs imposed by President Donald Trump earlier this year. The court found that the administration’s actions exceeded the statutory limits of the International Emergency Economic Powers Act (IEEPA), and, in doing so, violated the Constitution’s separation of powers.
The ruling is a decisive pushback against the use of emergency declarations to bypass congressional authority on trade, and it places new judicial limits on how far future presidents can go in using IEEPA as a tool for tariff policy. Two Tariff Programs, One Core Problem
The court reviewed and ultimately invalidated two related tariff programs:
Trafficking Tariffs: These included 25% duties on imports from Mexico and Canada and 10–20% on Chinese imports. The White House justified them as part of a national emergency response to international drug trafficking and cartel activity.
Worldwide and Retaliatory Tariffs: A blanket 10% duty on all U.S. imports, with enhanced rates (up to 50%) targeting 57 countries. These were tied to a separate emergency declaration citing long-standing trade deficits and lack of tariff reciprocity as threats to U.S. national security.
While the factual justifications differed, the legal question in both cases was the same: Does IEEPA give the President this kind of unilateral authority to set tariffs?
I think Trump will have have trouble reversing this decision, this is not some rogue judge, this court has legitimacy to decide this type of issue. Having said that, I don’t know enough about the composition of this court to know if it is ‘political” or not.
Also I doubt Congress would approve these tariffs.
So this might be good news for the American consumer.
“Elections have consequences. Rs only have a very small majority in the House.

-Just to remind everyone: The BBB is a reconciliation bill, so the Republicans only need to get majorities in each chamber of the legislature. It should be pretty easy to roll back spending amounts to 2019…….but it doesn’t look like that will happen.
“Take what you can get.” is Quichuan for “Thank You Sir, May I have Another!?!?”.
“”During the Biden administration, hundreds of billions of dollars were funneled towards pet green projects, while the American fossil fuels industry was punished, and there is no evidence that Biden ordered it, directed it, or was even aware it was happening in his name,” Turner added.”
-BUT OF COURSE, the “more-conservative-than-Trump” Republican Congress has not yet CUT OUT all of this boondoggle $$$ from the budget talks.
Start with section 301/302 of the trade act. There was a finding by the us trade rep and his work is 200 plus pages.
“Section 301 of the Trade Act of 1974, as amended, requires that the U.S. Trade Representative (“USTR”) take action, which may include imposing tariffs, where “the rights of the United States under any trade agreement are being denied” or “an act, policy, or practice of a foreign country” is “unjustifiable and burdens or restricts United States commerce.” 19 U.S.C. § 2411(a)(1)(A)–(B). The USTR may impose duties also where the USTR determines that “an act, policy, or practice of a foreign country is unreasonable or discriminatory and burdens or restricts United States commerce.” Id. § 2411(b)(1). This power is conditioned on extensive procedural requirements including an investigation that culminates in an affirmative finding that another country imposed unfair trade barriers under § 2411(a)(1)(A) or (B) or § 2411(b), and a public notice and comment period. See id. § 2414(b).”… [source]”
Lol – what a twist of words here by the court of leftist commies:
“With these principles in place, the court turns to the interpretive question at hand. Recall that both TWEA and IEEPA authorize the President to “regulate . . . importation.” See 50 U.S.C. § 4305(b)(1)(B); id. § 1702(a)(1)(B). The court in Yoshida II noted that “[t]he express delegation Court Nos. 25-00066 & 25-00077 Page 29 in [TWEA] is broad” and includes the power to “impos[e] an import duty surcharge.” Yoshida II, 526 F.2d at 573, 576. While the words “regulate . . . importation” may exist in identical form in IEEPA, those words do not confer unlimited tariff authority.”
I think the issue is not whether the President can impose tariffs, it is what justification he used. Somewhat akin to the deportation issue.
The Court let stand the tariffs and aluminum, steel and other items. It is saying he can’t use the Emergency Economic Powers Act (IEEPA) as justification.
It seems like he could still impose the tariffs using another justification.
As i said above, I don’t know the composition of this trade court.
If it is indeed composed of leftist judges bent on thwarting Trump’s agenda for political purposes, fine with me if it is reversed, even if I agree from an economic and ideological view that these tariffs are wrong and should be eliminated.
In a perfect world, the argument for free trade, free markets and free enterprise should win out in the battle of ideas, not mandated by courts.
It is difficult to imagine the overwhelming damage this court has done to all of the trade negotiations that are presently in progress. In one swoop, the Court has deprived the United States of all of its leverage at the bargaining table. Who needs enemies when we have the judiciary.
Goldman Sacks came out with statements equivalent to saying this international court ruling was a “nothingburger,” having various workarounds availing themselves for the purposes Trump wanted. What did surprise some was the speed in which the Trump legal team appealed this ruling.
Two of the three judges on the trade court leaned conservative – one appointed by Reagan, the other by Trump.’
Not surprised.
There is nothing “conservative” about tariffs.
Nothing “conservative” about economic isolationism.
For decades these were the banners of the fat cat union bosses, the failed AFL-CIO agenda, of people who gave the Democrats hundreds of millions to defeat conservatives.
12 cents of every USAID dollar was directed towards charitable purposes. The rest of that dollar went into the pockets of opportunists, or into covert operations abroad, usually managed in some way by the CIA.
OBSTRUCTION: Top Tennessee Democrats putting the lives of ICE agents and their families in danger. The mayor has posted the identities of ICE agents working in Nashville on the city’s website allowing cartels to target them and their families. Democrat State Rep Justin Beh has admitted to blocking ICE vehicles in an effort to allow illegal aliens to escape arrest.
Tariffs are good when they are 1) implemented to protect a country’s emerging industries (which helps business owners, stockholders, workers and the local and national governments that get revenue from these industries) 2) to prevent unfair trade by countries whose governments subsidize the manufacture of steel and other critical goods and 3) to protect various industries critical for national defense (such as shipbuilding, military aircraft, etc,)
At one time in our history, they were an important source of revenue for the federal government. Less so today.

A federal appeals court granted the Trump administration’s request to temporarily pause a lower-court ruling that struck down most of President Donald Trump’s tariffs.
The Trump administration had told the U.S. Court of Appeals for the Federal Circuit that it might seek “emergency relief” from the Supreme Court.
A larger investment on the horizon from John Deere:
”According to the company website, John Deere will invest $20 billion in the United States over the next decade, with hometowns where these investments will go seeing a projected $25 billion impact.
Factories in Tennessee, North Carolina, Missouri, Iowa, and Illinois will see new expansions, new assembly lines, or new factories altogether. Additionally, the company boasted a majority of the raw steel used in these factories will be from the United States.
A more specific breakdown showed new assemble lines in Waterloo, Iowa; an expansion to the factory in Greenville, Tennessee; a new excavator factory in Kernersville, North Carolina; a 60,000-square-foot expansion to the factory in Moline, Illinois; and a 120,000-square foot expansion in Missouri.”
”A federal appeals court put the brakes Thursday on a lower court order that overturned most of President Trump’s sweeping tariffs.
A full 11-judge panel on the US Court of Appeals for the federal circuit stayed the order by the Manhattan-based Court of International Trade while the White House appeal is heard.

The tariffs had been challenged by a dozen states and five small business — which the appeals panel gave until June 5 to respond to Thursday’s stay”
reflects on his coverage of Joe Biden’s mental decline: “I would not say I was incurious. I would say that I was one of the many people who was asking about this and was lied to over and over… I don’t know what more we could have done.”
To be fair to Jake, he would have done the same with Trump, no doubt.
