    I’ve read the newly released decision from the 4th Circuit denying the Administration’s Request for Stay pending appeal of Judge Xinis’s order for expedited discovery.

    The 4th Circuit is not helping her cause. Remember that the 4th Circuit denied the stay request on her Order that Abrego Garcia be returned to the United States on a Friday, giving the Admin. until the following Monday at midnight to do so. The Supreme Court not only stayed her order, it remanded it with instructions. Judge Xinis did not follow the instructions. SCOTUS told her to explain what she meant by “effectuate.” Rather than do that she deleted it from her original order, and the new order simply said “Factilitate” his return to the US.

    The SCOTUS had read her original order as to “Facilitate” his release from custody in El Salvador. She never even mentioned that when she ordered again he be “returned” to the U.S. Now she has ordered the Govt to answer discovery about what the Govt has done to “facilitate” his return to the US when that is not what SCOTUS affirmed. The Govt said “We read facilitate” as used in immigration regulations, and responded accordingly. Today the Fourth Circuit says “Read “facilitate” no as used in a regulation but as commonly used.” Ok – Judge Xinis never said that. The was told to define what she meant by effectuate and she just deleted the word. She has never been specific about she meant by “Facilitate.” Even after the Fourth Circuit order the Govt does not know — other than the ultimate result — what steps she is directing the Govt to take. She has been unwilling to do that because that would create a basis to appeal on the claim that her order exceeds her authority. But that is why the SCOTUS said “Describe what you mean” — so everyone can evaluate whether what she means exceeds her authority. The Fourth is running cover for her — but she did not comply with what SCOTUS told her to do. This is going back to SCOTUS ASAP and I don’t expect that they will be too happy that the lower court judges seem to not be able to find their own limits on what it is they might be able to accomplish.

    I’m starting to see A LOT more of these logging trucks throughout Western North Carolina. President Trump allowed logging companies to start clearing some of the fallen trees from Hurricane Helene so they can use them for cheaper timber to rebuild homes. Absolutely incredible!

    Police identified the suspected shooter as 20-year-old Phoenix Ikner, a student at the school. They also said his mother is a Sheriff’s Deputy, and said Ikner used his mother’s weapon in the killing. His mother has been an officer for over 18 years and authorities say she has done a “tremendous job.”

    Have the Democrats called on a ban on guns for Sheriff Deputies yet?

    Murkowski has been a conservative and a Republican for what, decades before Trump stopped donating to Chuck Schumer, Harry Reid, the DNSC, Planned Parenthood, etc. but she is the RINO.

    Not yet mentioned anywhere that I can see in the analysis of the Supreme Court’s remand of the Abrego Garcia case is any reference to the following: “For its part, the Government should be prepared to share what it can concerning the steps it has taken and the prospect of further steps.”

    It is this part where Judge Xinis has take issue with the Govt reports, and has now granted the plaintiff’s request for discovery. This game can go on several more rounds because …. “what it can” gives to the Executive the discretion to share or not share information based on its own needs and prerogatives.

    Every response to discovery at this point can begin with “The United States cannot, at this point, share any informations responsive to this interrogatory/request for documents due to ongoing diplomatic efforts that may be compromised by public disclosure, and any information given to Plaintiffs or Plaintiffs’ counsel at this juncture creates an unacceptable risk of such disclosure.” Next.

    As I said, all I wanted was for him to beat Harris, secure the border, lower taxes, appoint conservative judges and keep the military strong. Anything else is a bonus.

  29. Walt – Somehow, Shepard U didn’t make the list. 2 of her friends went to WVU. I is graduating with a teaching degree in a few weeks. The other went to too many parties, fell off a wall and broke her ankle, and failed out. She is attending college closer to home now.

    -The first part isn’t worth arguing about. Murkowski, unlike Susan Collins, should be much more of an ally to both Trump and the Republican Party than she is, since a strong conservative will be elected and re-elected in the state of Alaska. Alaska, and the United States Senate, could do MUCH BETTER than her.

    As for the second part, simply LUDICROUS. Trump is one of the most unideological person to be elected to be President, His whole life and persona has been trying to both bring people together to make deals and also to make people like him. And, as the video proof from the mid 1980’s until now shows, he definitely stands for something, and has been consistent about it, even if you don’t happen to agree with him on all of it.
