Yep, and that will be the basis of his appeal. I think it is likely that on appeal to the SC he will prevail on that basis. Not to mention he has other good grounds for appeal, especially the “upgrading” of a misdemeanor to a felony.
But Bitter is correct that in order to appeal, you have to be sentenced first.

Actually, the “President is immune from criminal prosecution” is not correct either.
He is immune from criminal prosecution for official acts. He will appeal his sentence claiming some of the testimony was “tainted” because it was related to official acts, but that is for the appeals courts to decide.

I said expect because, apparently unlike the Cult, I don’t practice Federal appellate law. I said he should win. However, having appeared before hundreds of Judges, Arbitrators and juries, I can assure you that not everybody applies the law alone. People like Tina are result driven and have no interest in the law.

I’ll answer the two questions I posed to Bitter….
1. Every person convicted of a crime has the right to appeal.
2. Appellate judges do not change the outcome on the merits of criminal appeals based on the sentence imposed (unless the sentence itself is the subject of appeal). Bitter’s experience at the trial level in civil cases is not relevant to this question.

The Court voted 5-4 to allow sentencing but did so on the assumption that Merchan would issue an unconditional discharge without any jail or probation. The question is whether Merchan could now pull a bait-and-switch. It is highly unlikely but intriguing.

I believe a judge may be able to reconsider a sentence on a motion for reconsideration by the prosecutor or defendant. He may be able to do it on his own motion (sua sponte) but would be even more proof he is a partisan hack.

What is the “rule of law” anymore? Does it mean anything clear or tangible when it can be conveniently altered or twisted to fulfill a politicized means to an end? The very trial convicting Trump went thru so many legal machinations, including having it tried in a biased jurisdiction, just to insure a legal outcome that would smear him as a “felon.” The rule of law, IMO, is rapidly becoming an in just sham.

Did I say Happy New Year to all? I forget if I have checked in or not.
Rough going, the wife and child and I got RSV after Christmas, it has been a long 2 weeks. Actually missed 2 days of work (originally was slated to be on vacation, but our plans were cancelled because an aunt got sick and didn’t want any visitors) because couldn’t catch my breath when working, so that sucked. The bitter cold hasn’t helped, either. BUT, was good to rest and spend time cooking with the wife, and chilling with the son.
A close 2nd for sucking were one of the posters repeated idiotic internet-tough-guy comments, which make this site less appealing to visit. Oh well, some things change, some things stay the same.

The SC judges specifically couched their decision on the fact the judge had stated he would impose an unconditional discharge sentence.
Now, this wasn’t a decision on the merits of the case, but they definitely considered the sentence in their decision.

Correct, it’s an interlocutory appeal (one that occurs while other aspects of the case are still at the trial level). Bitter was referring to appeals after the sentence.
I suspect that, if the case is appealed on the merits to the Supreme Court, they will throw out the conviction (6-3, at least) and order a new trial, consistent with it’s ruling in the Trump immunity case.

This oatmeal theory could also apply to a judge who had a bad argument with his spouse, whose dog just dies, whose daughter just got divorced, or a million other possibilities.
Together, they are examples of the psychological defense of displacement, where a person who is distressed about something in life takes it out in a “safer” place to do so.
