    Sorry, that is not what Fed fiscal policy should be about, knee jerk reacting to short term events.

    The rise in oil prices has one cause, the Iran war. It is not due to some intrinsic issue as for example an oil producing shortage driven by higher demand or a natural disaster with long term effects.

    This rate hike was a political hit on Trump just like some of the rate cuts were designed to benefit Biden. It is basically Kabuki theater that will marginally impact the economy negatively while doing nothing to reduce inflation.

    I understand why Warsh chose not to die on this hill, there will be bigger fish to fry.

    Still, this rate hike was unwarranted and a mistake.

    Hispanics that helped Trump win were not illegals.

    That being said, deporting illegals with long established roots and with American spouses and children should not be a priority.

    The priority, besides criminals, should be the 11 million recent arrivals allowed by the Biden administration.

    Talarico seems to have peaked out at about 47%.

    Possibly (hopefully) there is a contingent of voters like me that would not support Paxton in a poll but will end up having to hold their noses and vote for him anyway.

    So I think Paxton might get the majority of the still undecided and eke out a narrow win.

    Still, Cornyn would probably win 56-44 and require a fraction of the money wasted on Paxton.

    They have the Dems with +8.7 on the generic ballot.

    They have the Senate with 52 Dems.

    Paxton doesn’t have a lead in ANY of their polls.

    Then Cornyn doubled down, quoting Rove’s line: “The GOP’s stables need a cleaning. This is a good place to start.”

    Both men are voting for the Democrat Railroad Commissioner, as a rebuke for a picture posted by the Republican candidate which they have labeled as “racist.” It’s a garbage reason for something that was critical of our overrun borders, siding with support for mass deportation.

    Jason here is the thing on the generic ballot. I keep track of this myself and while the RCP is 8.7, they include pollsters with a very limited history of doing generic ballots. In my analysis the gap is Dem +4.8 when the average includes only the pollsters with a decent history of doing these, at least over three or more cycles.

    Well, well.

    The holdout juror finally speaks out. He is Michael Desronvil, 48.

    What he says we already knew. Most of the jury (8) was comprised of Karen AWFLs who had decided before ANY deliberations that Clancy should get a free pass. He describes them as “activists”.

    He says there were 4 jurors willing to look at the evidence, and that one (a woman) stuck with him on not letting Clancy off until the very end when she caved too.

    He also says he disclosed his prior arrest on the questionnaire, but as we know that wouldn’t disqualify him anyway.

    Hopefully the next jury will have more Michael Desronvils and fewer Karen AWFLs.

    Even if you are right, that is the BEST case scenario.

    If it is even let’s say what you think it is and the RCP average, say 6.5 or 7, it will be a disaster.

    So I wouldn’t be too excited about 4.8.

    The only caveat is that IF it is 4.8 as a national average, it will be lower than that in swing states.

    First, the avg national price of a gal of gasoline is artificially skewed by CA gas prices.

    Here in WV it is $3.99/gal.. Tbough some places here have it at $4.19. Nowhere in THIS region of MD, WV and VA is gas at or above the $4,38 national average.

    Secondly, in STATE elections for GOVERNOR, there are big state specific issues that are of major importance that may cause voters to go opposite ways of how they vote for GOVERNOR and for CONGRESSIONAL candidates.

    MN is a prime example.

    I would surmise that a lot of MN of all political stripes are livid about the BILLIONS of dollars of fraud that took place in MN

    This took place under D governor. This election will give MN voters their first chance to show disapproval to D governor candidate.

    There is some % slice of D and I voters who are going to vote R for governor amd still vote D for congressional candidates. Thus giving a leg up tobMN governor candidate.

    I am not up to snuff on OREGON, MICHIGAN, NEW HAMPSHIRE, MAINE, ETC. concerning very big STATE issues weighing on voters minds there that may sway 5% or more of the voters.

    I know that in WV, the big STATE issue revolves around data centers and new big power line proposals running hundreds of miles thru W. To service D,C. area . I expect some incumbent Rs in state legislature will be defeated here due to this issue in November.

    This person’s own mother called him evil even before the Clancy trial. His own nephew called the police on him and asked the court for a restraining order on him-and this is from a 13 year saying this his uncle “ruined his life”. His marriage broke up right after he grabbed his wife by the throat and threw her into a dresser.

    And his landlord called him a serial liar.

    His own mother, his own nephew, his ex-wife and his landlord.

    Yep, we need more Michael Desronvils.

    Valid point by J-Hole, but whether or not some factor “should” or should not factor in to fiscal policy is a different discussion, the fact is that short term pricing pressures absolutely do factor in, regardless of how any of us feel about it. And one of the two mandates of the Fed is stable pricing (other being max employment).

    On the political side, I don’t see this politically damaging Trump or anyone. If a short hiking cycle prevents gas prices from reaching $5, then that’s a good thing for Trump.

    Markets are already back to yesterday’s levels. Bonds unchanged. Like I said yesterday: “Non-Event”. 12 months from now: Same people who don’t like this will be touting it as the responsible thing to do.

    This juror was as LEGITIMATE as any other and nothing in his history prevents him from weighing the evidence and reaching the conclusion he did.

    I have mostly stayed out of the Clancy debate. But its just a part of the larger problem we now have where people do not value life. I recall a story years ago when a very fat teenage girl got pregnant, and nobody knew because the extra weight wasn’t even noticeable. She ended up giving birth in some bathroom somewhere, and just killed the baby.

    Then she was stunned that her act bothered anyone, much less leading to her arrest. She reasoned that she could have killed the baby just a week earlier and she would be applauded, so what’s the difference waiting until it was born when she aborted it after the manner of the ancient Romans?

    The women on that jury see it the same way, what’s the difference waiting a few years after these kids were born to eliminate them then when they aren’t wanted?

    Because killing viable fetuses up to the day they are born is not enough.

    The AWFLs want the “right” to kill your children beyond that, under the guise of “making women’s lives better”.

    As the juror said in the interview, they were hoping to showcase this trial so “no woman would have to go through this again”.

    And that is the meme. The defense lawyer argued there should be no retrial because of “what this (wonderful) woman went through”.

    Nobody cares about what the innocent little kids “went through” as they were hunted down and slowly strangled by their mother.

    Well, one juror did, a few others at least took into account. Kudos to him.

    John Goggin and I have different heroes. His heroes are the murderer and the people who want to give her a free pass. My hero is the guy who was there to evaluate the evidence on THIS case, not to use the trial to “make things better for (murderous) women”.

    How is this for a fact.

    None of the history of the juror, including the fact he was never convicted of anything and charges were dropped, precluded him from being on the jury.

    And none of his history in any way precluded him from weighing the evidence and rendering his verdict.

    The only difference was he was not there on a mission to showcase this case as a way to “improve lives of women (by allowing them to kill their children with impunity)” like at least 8 of the jurors (some who already admitted it in interviews).

    It seems he didn’t view the children as props to sacrificed for the “greater cause” but as the real victims. k

    The MSM, the defense attorney and most of they jurors successfully shifted the focus from the real perpetrator and the real victims to making the murderer the victim and society the perpetrator.

    Hopefully, the prosecution will not let that happen the second time around.

    This is what the Karen AWFLs said, no evidence it is even true.

    And let’s hear from him why he “believes what he believes”.

    As far as the water bottles, he was right to show the AWFLs that forgot why they were there, it was about the murdered children, not “make women’s life better”.

    I hope he reminded them everyday of how horrible it was to be strangled like that, even if it did move the AWFLs on their “mission”.

    Devlin remarked that the panel felt the case was a “turning point” to change things and make conditions better for women and families in the future.

    That was the mother of all red flags.

In the Clancy case, they were to decide whether she was criminally responsible.”

    The jury’s role is to apply the law, not to make law, he said.

    I am on record as saying newspaper endorsements don’t swing any votes. In the first place few people nowadays read newspaper editorials, and those that do aren’t going to vote based on them.

    However, more people “hear about the endorsement” than read them. So the “liberal city paper endorses Rogers” meme might be marginally helpful.

    I have NEVER understood a verdict of Not Guilty by Reason of Insanity.

    The charge is the charge.

    Bank robbery, hijacking, murder, whatever.

    A jury verdict of NGBR of Insanity says , “OH, no bank robbery, hijacking, murder or whatever ever took place.NEVER HAPPENED.

    ##########

    The jury should return a verduct of innocent or guilty.

    Or not guilty due to justifiable homicide or self defense…

    The jury could further say:

    Guilty, but really emotionally distraught when crime was committed.

    Guilty, but had a lot going on in there life at the time.

    Guilty, but someone else forced them to commit the crime and threatened to kill them if they did not commit the crime and had a gun to their head.

    Guilty, but high on drugs at the time.

    Guilty but were sleepwalking at the time and really did not mean to cause thus harm.

    Guilty, but drunk out of their mind when they slammed into and killed those people and their whole life showed that when sober they would never do such a thing.

    Guilty, but insane and absolutely nutty as a fruit cake and has never had any sense of reality

    Guilty, but brainwashed by ISIS into believing nutty things.

    Guilty but temporarily insane (to me, any crime of passions could be considered temp. Insanity).

    Guilty, but is a psychopath or sociopath…

    THEN, the judge or jury considers the “guilty but…” when they get to the sentencing phase and meteing out the punishment.

    Walt – In order to be guilty of an intentional crime, the jury must find that the Defendant had the guilty mind (men’s rea) to commit the crime. It does not mean that the crime did not happen. It means that the Defendant did not have the capacity to intend to commit the crime. It goes back in English common law to the 1840s. Blame the Brits.

    Well, as Bitter points out, the insanity defense does exist and is legitimately used in some cases. Insane people do commit crimes.

    Of course, many sane people try to get off using the insanity defense, but often they are deemed fit to stand trial.

    The Clancy case is one of the most obvious cases of bastardizing the insanity defense I have ever seen.

    The insanity defense is not for crimes just deemed “crazy” or “horrible”. The 9/11 hijackers flew planes into buildings killing thousands of people. That was “insane” but the hijackers were not crazy even if we think of the crime as nuts. Cruelly strangling your own kids is so barbaric a thought for most people that the gut reaction is “Geezus, you have to be crazy to do that”. but that is not the insanity standard.

    Also mental illness is confused with insanity by a lot of people. Mental illness is not a get out of jail card, the jails are full of people that are mentally ill. Mental illness is a medically diagnosable condition that covers a very wide spectrum of symptoms. Clancy suffered from depression and was medicated for various conditions. She was not, however, diagnosed as psychotic and none of her therapists, doctors, family, friends or co-workers believed she was psychotic and a threat to her kids.

    The burden for the insanity defense is quite high. You have to SHOW, yes prove, the defendant completely lacked the capacity to understand the nature or wrongfulness of the action at the time of the offense.

    If anyone following any of this trial can show ONE instance where the defense proved Clancy didn’t know right from wrong then you are probably also seeing freepassers everywhere.

    Now should factors such as medication, depression etc constitute, as Walt suggests, mitigating factors that might cast doubt on first degree murder? Yes, and that is why second degree murder and manslaughter were also part of the charges.

    Yes, in the federal system and the vast majority of U.S. states, the burden of proving an insanity defense is on the defense.

    How the Burden Works

    • Federal Courts: Under the Insanity Defense Reform Act (18 U.S.C. § 17), the defense must prove insanity by clear and convincing evidence.
    • State Courts: Most states also place the burden on the defense, though many require a lower standard of a preponderance of the evidence (meaning it is more likely than not that the defendant was insane).
    • Exceptions: A small number of jurisdictions (such as Massachusetts) require the prosecution to prove the defendant’s sanity beyond a reasonable doubt once the defense introduces some evidence of a mental illness.

    I don’t think there is any reasonable doubt Clancy is very much sane as shown by the evidence that this woman was fully functional with no evidence of psychosis and the murders were carefully planned.

    This is a mortifying admission. It tracks with the holdout juror’s description of the jury deliberations as “activists” who had their minds made up from “day one.” 

    In the same interview, Devlin repeated her delusional narrative that the Lindsay Clancy case was about sending a message.

    We thought, this is a real opportunity to get people talking,” she said. “That’s all we really thought.”

    When told that people are “talking,” she “giggles” and adds, “Yes, they are.”

    Sick. The children are still dead as she giggles about her mission.
