Phil, whether or not we win or lose, STOP listening to Baris. He is completely discredited. He was openly rooting for Massie and kept putting out poll after poll in the final days of that primary showing Massie tied, and that turned out to be nothing but cheerleading. I disagree that NC is already gone. That High Point University poll had Cooper up only 5. PPP-D had it at 4. Its not over.

DW, I completely understand what you are saying about Baris. I absolutely do…..and he was indeed cheerleading for Massey. However, that was a primary. Unfortunately, his polling in the last three presidential elections was right on the number. The accuracy of his GE polling has me concerned about November. God help us if Democrats get control of both house of congress. Democrats have told us up front what they will do to the filibuster. They haven’t made it a secret. Both houses and the WH and you can count on packing the high court, statehood for DC and Puerto Rico (4 more permanent Democratic Senators). Hello open borders and the rest of the socialist agenda. There will be nothing to stop them from completely changing America. Nothing standing in the way.

I have said many times that if you want to know what the true Dem internal polling is showing, then just watch their behavior. Just look at the behavior of Jeffries and many of the others who are refusing to campaign with El-Sayed and are desperate to distance themselves from antisemitism and Piker and the DSA. But their problem is now that its not just goofy old Bernie Sanders. The DEMS have completely lost control of the party, and now its being run by the DSA. And that is a legitimate fear in competitive areas of the country.

Phil, see its that very sort of fear that the GOP will use in the next two months to drive Republicans to the polls and win over independents. And don’t get me wrong, I am not a blind cheerleader who thinks everything is rosy. Its going to be dreadfully close. But again, the data I see right now isn’t all bad. Not great, but not all bad either. And I still see that the most intense hatred of Trump and Republicans is found in areas that are deep blue already anyway.

I would also point out that in all my years of following this stuff, I have never seen so many “new” pollsters dropping polls left and right, mostly hard LEFT.
This makes me very suspicious that there is a degree of gaslighting going on. And we have already seen evidence of this. Francesca Hong was between 15 and 20 points ahead in the polls except she lost. El-Sayed was way ahead in the polls and barely held on to win.

I think Phil’s fears are legitimate. Baris represents a faction of “conservative” deadenders that actually want Rs to lose because Trump (to his credit) did not follow-up on the isolationist rhetoric of “no endless wars” BS and actually moved to defend American interests in the ME. The deadenders don’t understand that while Trump IS an isolationist at heart, he has to govern and he knows that Russia annexing Ukraine and Iran and its terrorists proxies controlling the flow of oil and having nuclear weapons is not in our interest and won’t happen on his watch.
Baris is actively trying to “demotivate” the base so they stay home on the theory “the House and Senate are gone” why show up.
The Baris, Carlson, Candace, etc. faction does have its followers and they could make a difference in the end.
The key here is will the independents who supported Trump in 2024 now switch to the Dems because of the cost of living issue being exploited (successfully) by the Dems, or will they be wary of the leftist extremism dominating the Democratic party and shy away from it.
Again, I am concerned about a wave election. All these close races could go one way if that happens. While DW may be right that the polling does not show a blue wave per se, the fact that solid GOP states like OH, IA, TX and AK are considered toss-ups means they might all go DEM if the wave happens.
My hope is that Talarico is really like a new Beto. A lot of hype, polls showing it close, etc. but in the end he lost (narrowly). But if disaffected Cornyn voters, and there are a lot of them, don’t vote for Paxton he could lose. He is a bad candidate, I have said this from the beginning. Way too much baggage, Trump should have supported Cornyn, a shoo-in to beat Talarico.

The one caveat I will make on Phil’s comments is that the filibuster won’t be ended while Trump is President even if Dems win the Senate. It won’t do them any good because Trump would veto everything.
The danger is 2028 and beyond if the Dems win both houses and Congress and the Presidency. Then you will quickly see the emergence of a one party state.
Not that losing the Senate wouldn’t be a disaster. They would not approve ONE nominee for judges, so Trump’s win in 2024 will not make a big difference in the federal bench. There would be endless investigations and Trump would be lamest of the lame ducks for 2 years.
I hope people like Elon Musk are paying attention.

But I have to keep stressing the behavior of Dems in leadership. They are desperate right now to at least appear that they have wrested control back from the DSA. If the DSA was a winner at the polling booths, then they would be fully and openly embracing it. This means that GOP ads hammering the Dems as having been taken over by the commie DSA will hurt Dems’ chances.

If I still lived in TX and was still a R, I would have voted for Cornyn in the primary and would vote for Paxton to keep a nutjob like Talarico out of the Senate.

I am not sure the commie issue will be that effective in states where the Dem candidates (wrongly) are not viewed as commies, such as OH, NC, AK, etc.

They stress that she won after only spending $57 k. They don’t really mention that her “mainstream Dem” opponent only had $315k to spend.

🚨 JEFFERSON COUNTY SENTENCING: 18-YEAR-OLD RECEIVES 37–160 YEARS IN PRISON FOR VIOLENT 2024 ATTACK 🚨 JEFFERSON COUNTY, WV — Isai Osmar Chinchilla-Guerra, 18, was sentenced Tuesday to 37 to 160 years in prison following his conviction on 14 felony charges stemming from a violent May 2024 attack on a Jefferson County woman. Jefferson County Circuit Judge Bridget Cohee ordered all sentences to be served consecutively. A jury convicted Chinchilla-Guerra in June on charges including attempted first-degree murder, first-degree sexual assault, six counts of malicious wounding, assault during the commission of a felony, burglary, fleeing law enforcement with reckless indifference, possession of a stolen vehicle, and bringing stolen property into the state. According to evidence presented at trial, the victim was attacked after returning home. Prosecutors said she was struck with a cinder block, sexually assaulted, stabbed and cut with a screwdriver, and strangled. She was ultimately able to escape and seek help from a neighbor. Authorities said Chinchilla-Guerra fled in a stolen Toyota RAV4 that had been reported stolen in Loudoun County, Virginia. Jefferson County deputies pursued the vehicle through Charles Town before losing sight of it. The SUV was later located crashed and engulfed in flames off Summit Point Road. Both the victim and Chinchilla-Guerra were transported by helicopter to a Northern Virginia hospital for treatment. Chinchilla-Guerra was 16 years old at the time of the offenses. During his trial, the defense argued that Chinchilla-Guerra was not criminally responsible due to mental illness. The prosecution presented expert testimony disputing that conclusion, and the jury ultimately rejected the defense and returned guilty verdicts. During Tuesday’s sentencing hearing, the victim told the court the attack permanently changed her life and sense of security. She and several family members asked the court to impose the maximum sentence. Before sentencing, Chinchilla-Guerra apologized to the victim and her family, telling the court, “There is no excuse.” Jefferson County Prosecuting Attorney Adam Ward requested the maximum sentence of 37 to 160 years, with the sentences served consecutively. Because Chinchilla-Guerra was a juvenile when the crimes occurred, West Virginia law makes him eligible for parole consideration after 15 years. I was visiting my sister in the Dallas area this weekend. My brother in law is a Republican and was the Republican county judge for Kaufman County. We got on politics and he shocked me. Said Paxton was a criminal and an adulterer. Said he was voting for Talarico. I thought he was kidding but no. Said you couldn’t pay him to vote for Paxton. When I reminded him of what a leftist nut Talarico was his response was “Yeah, I know but maybe he won’t do too much damage”. That was the end of our political discussion. So yeah, as Jason says, in a wave election it could all go one way – the wrong way. Also, Jason is right. Democrats won’t nuke the filibuster while Trump is President. The danger is that Democrats capture the WH in 2028. If at that point they have all three branches, you better be damned right they’ll nuke the filibuster. At that point nothing will stand in their way in remaking America. Nothing.

Senior FBI psychiatrist says Clancy was not experiencing postpartum psychosis.
“Lindsay Clancy had the “capacity to appreciate right from wrong” when she strangled her three children, according to the testimony of Gregory Saathoff, the longtime forensic psychiatrist testifying as a prosecution expert.
“My opinion is that she did have the capacity to appreciate right from wrong,” Saathoff testified. “It is my opinion, within a reasonable degree of medical certainty, that Ms. Clancy was criminally responsible.”
Saathoff noted that, in his opinion, the killings required “significant” planning and that her actions earlier that day suggested she was able “to conform right to the type of behavior that a concerned mother would engage in.”
While Clancy says she heard a voice in her head commanding her to kill her children, Saathoff testified that the voice did not tell Clancy the specifics about how to kill the children and what to use, suggesting she “had control of the sequence of what she was doing throughout,” based on the 11 hours he spent interviewing her.
Saathoff also testified that, in his opinion, even if Clancy was experiencing postpartum psychosis, she could have differentiated between right and wrong or pushed back on the voice she reported.
“Command hallucinations, when they occur, do not propel an individual to automatically obey them. And in fact, many people will engage in behaviors to stop them,” he told the court.”

Despite Jason’s condescending lecture, I see Paxton as a better policy candidate than Cornyn. He has dealt with gender mutilation issues, been for more election integrity reform, and willing to act more aggressively to support conservative agendas, instead of staying in a spineless establishment zone, like Cornyn was in for years. Furthermore, the Texas grassroots will be activated far more in their GOTV efforts than they would have been for Cornyn. It’s these grassroots who have tenacious commitment towards their candidate that win elections. Moscow’s troops are grinding towards the so-called fortress belt of industrialised cities in the Donetsk region, which the Kremlin has demanded that Ukraine give up before it ends its war.
Visiting the front line with his new top general, Zelenskiy said Third Army Corps leader Andrii Biletskyi and Denys Prokopenko, commander of the First Corps Azov, will head new groupings aimed at strengthening defences around Donetsk.

This is an important point.
While postpartum psychosis is rare, women who experience it are still very unlikely to actually harm their children.
Postpartum psychosis is NOT an automatic get out of jail card even if real.
To start, postpartum psychosis only affects roughly 1 or 2 of every 1,000 deliveries (0.1 to 0.2%).
THEN only about 4% of those women who experience it actually harm their child.
So the defense contention that hey, she had postpartum psychosis (denied by the prosecution witnesses) so killing her children was a natural outcome is complete and utter BS.

When the mother of my three girls was going through postpartum depression and hearing voices I took her into Harbowview Psychriatic Hospital, signed the papers, and remember the door being locked. And had the three girls safely at home. With the help from my church I managed through this.
I used up all of may vacation time, sick time and thanks to the Family Leave Act was able to get through.

In hindsight of course that should have happened. But contrary to you, maybe her husband did not see what you saw in your wife that caused your concern.
She was evaluated and the people who treated her have testified they did not deem her a threat to her children based on the clinical assessment. Maybe her family felt the same way.
So either they were wrong (denied by the prosecution witnesses) or she was bent on killing them independent of any diagnosis.

Of those 731 WV who died in Vietnam, about 20 were from my home county of Berkeley.
I personally did know any who died. Their names are on a big statue in our War Memorial Park. Names of our county boys lost in each war since WW I.
Did know a number of guys who served in Vietnam and who came home afterwards.

Saturday we drive to Woodstock VA for wife’s HS class annual reunion.
Sunday is 365 days of son’s recovery and alcohol and drug free. We plan to do something with him to celebrate on Sunday.
First week of September is free (for now). I am expecting incoming Phone fire from Goofball at the Rescue Mission once his SS check gets auto deposited in his bank account.
September 5 through Sept 14 we will be in Maritime Provinces in Canada eating lobster and spying on what the Canadians are up to. One day after we get back, we deliver meals on wherls. Then some fundraising dinners to go to, and other stuff…
October 22 thru 26 have a trip to a Michigan lake house planned to be with friends from VA and Illinois.
Plans finalized for trip to Spain and Portugal next year where I can ask people in Spanish “Where is the library?” (Donde es la bibliotec?). Glad my 2 years of H S Spanish classes will FINALLY come in handy…

I have never said how I would vote on the jury. I have said I am looking at the case as a lawyer and not as an A-hole.
Both sides are making their best case. Experts disagree all the time. You don’t seem to realize that. You think the fact that the prosecution’s expert testified to “a reasonable degree of medical certainty” makes it an open and shut case. It doesn’t because the other side’s expert does, too.

No, testimonies do not need to be given equal weight, I am sure you know this.
Open and shut cases have BS witness testimonies all the time. There will be an expert who will say yes it was his gun and there are powder marks on his hand and he has victim blood on his clothes but that can all be explained away by contamination and blah blah blah.
So it is perfectly fine to give more weight to one testimony over another. Happens all the time.

I think the difference is the defense experts are bent on giving her a free pass and mold their testimony to that end. They have an ideological stake in the outcome. They become emotional during testimony.
I think the prosecution expert don’t really have a stake in the game, they are giving their honest assessment. It will make no difference personally to them if the prosecution wins or loses and that is reflected in their demeanor. That is why under questioning they have made statements that could be seen as helpful to the defense. Nothing the defense experts have said could be classified as helpful to the prosecution.
In the end it all Kabuki theater. The outcome is pre-determined. Clancy could have made a video where she says I am planning these murders and this is how I am going to do it and it wouldn’t matter, the wokesters would say see she is crazy, no one makes a video incriminating themselves if they aren’t.

Of course they do. They are paid by the prosecution and a conviction enhances their reputation. This also increases their ability to be called again as witnesses by any party, even defendants, in the future.
Most experts give something to the other side to actually enhance their credibility. Look for the prosecutor to argue in the closing, “Dr. X testified credibly on the most important issues in the case. Dr. X also testified that Y, which was also the opinion of the Defense expert. This confirms rather than undercuts the opinions of Dr. X.”

After 33 years as a lawyer, conducting hundreds of expert witnesses depositions, and deposing thousands of witnesses, I feel confident of weighing testimony and making arguments on credibility.

Investigators say York contacted the undercover officer while identifying himself as “Joe.” He initially wrote that he wanted to visit her, then followed up when he didn’t receive a response. The next morning, according to the report, he tried again. This time, the conversation went somewhere.
York allegedly told the person he believed to be a prostitute that he was coming from Boardman and asked for an address. He then asked for the price of an hour of “full service sexual activity.”

I do not understand why all of the people who endorsed Norman are surprised that he lost. Norman didn’t understand why he lost until today. People outside of SC understood. It was simple. He endorsed Nikki Haley in the 2024 primary. It wasn’t about Trump endorsing Darline, it was about Norman abandoning Trump when it mattered.
