  1. Back in the day, the Dems in the Senate eliminated the filibuster for Supreme Court nominations. I don’t recall Jason and Bitter saying Mitch should have reinstated the rule when the Republicans took over the Senate.

    Instead it was…..how can the Dems whine about Mitch using the new normal started by Dirty Harry.

    Now, though, the Dems have changed the game by using lawfare against individuals and executive branch functions. Instead of following Mitch’s lead, Jason and Bitter want the Republicans unilaterally forego the new normal started by the Dems.

    That’s the type of weakness that wins, baby!!!

  2. Speaking of the senate filibuster , Chicon, the City Journal has an interesting article this morning about the potential unintended consequences of lawfare and judicial activism –

    excerpt –

    ”The recent litigation over the Alien Enemies Act is the most high-profile example. Within weeks of the Supreme Court holding that claims challenging deportation under the AEA should be decided case-by-case in the jurisdiction of detention, the Court turned on a dime and issued a sweeping midnight order that seemed to provide class-based relief to aliens potentially subject to the AEA. It did so even after a Biden-appointed Fifth Circuit judge, Irma Ramirez, had dismissedthe appeal as lacking jurisdiction. For all the Court’s professed commitment to regular order in federal courts, it was a staggering side-step of orthodox legal doctrine in favor of “doing justice.”

    Even worse was the recent case in which a Boston district judge said that Trump couldn’t unilaterally end the parole program for Cubans, Nicaraguans, Haitians, and Venezuelans (CNHV). The Immigration and Nationality Act gives the attorney general authority to make “individualized” parole determinations, such as allowing a migrant into the country for an emergency medical procedure. Biden had abused this power, admitting four country-categories of aliens by executive fiat.

    Upon taking office, Trump quickly revoked CNHV parole. Not so fast, said the Boston judge: the revocation of the categorical parole program must be individualized. Terminating the unlawful initiative, she argued, “undermines the rule of law.”

    In fact, the plain text of our immigration statutes gives the president considerable tools with which to secure the border. But liberal lawyers, judges, and even presidents have deliberately violated these laws to serve their ideological goals. If that executive-and-judge-made problem can’t be fixed by another executive and different judges, then Congress may need to step in.

    And that could pose a problem for fans of the filibuster in the Republican-led Senate. Senate Republicans are highly motivated to address immigration. Having negotiated the last two significant, bipartisan immigration deals in the Senate, I have the scars to prove it. Republican senators are unlikely to sit by while the courts prevent Trump from using his broad immigration and national-security powers to enact his core agenda. Expecting them to cater to the demands of seven Democratic senators in order to fix a problem created by Democrats may be a bridge too far.”

    So far there have been 209 legal challenges filed, putting delays on Trump’s EOs and policies, during his 1st days in office – supposedly a honeymoon period given most presidents. This judicial tantrum compares to the 20-30 legal challenges (lawsuits, impeachment efforts, court disputes) experienced by all 44 presidents before him, spanning 227 years over 1789-2017. Even during Trump’s first term there were only 64 injunctions filed – perhaps because the Dems were too busy with investigating and impeaching their nemesis.

The fact he is publicly saying this now indicates he thinks Zelenskyy’s appeal has eroded with a war-fatigued populace. He strongly says Ukrainians do not want a Russian occupancy. However, ceding territory to Russia it already occupies might be worth having peace.

  54. My dad used to listen to a radio commentator named Paul Harvey. He and eventually his son produced a segment called “The Rest of the Story,” where they would take one well known news story, and then add on to it a 2nd half that was rarely known by the public. The Ukraine side has been vociferously carried by Zelenskyy, around the world, as he holds court with his hand out for more favors, money, and celebrity hood. Having a journalist on the other side is simply hearing an enlarged portion of the story. No one has to believe Lancaster, but fewer are also seeing Zelenskyy as the hero of the war either. There was a pre-war clip, for instance, of Zelenskyy, when he was running for the presidency where he claimed all he wanted was peace. He was also very much into not wanting to hurt his people. Now, all he does is flail around and seem to be gaming more for relevance than anything to do with lessening the suffering of the average Ukrainian.
