  7. winners also correct the wrongs of the past- particularly if we have to live with the consequences of those decisions in the current. This is an interesting move by Trump. He obviously knows autopen usage is legal. However, he also knows that Brain dead Biden didn’t make those decisions. In order for them to remain, brain dead Biden and his administration will have to defend them and insist Brain dead Biden was fully aware and consented to each. Imagine having to defend cop killers, child molesters and some of those other ridiculous pardons. It’s a win win for Trump. Even if the courts ultimately disagree, making the Dems defend those decisions will kill them publicly. That’s a winning strategy and move to me.

    With regard to EO’s he should state the law that supports it, which he is doing, and in addition the SC case/ruling that allows it. He should then state that any ruling that does not comply with the SC ruling/case will be ignored.

    Plaintiffs in a legal case against the U.S. government on March 17 urged a federal judge to seek answers from the government regarding compliance with President Donald Trump’s orders on deportation flights.

    “Plaintiffs remain extremely concerned that … the government may have violated the Court’s command,” lawyers for Venezuelan immigrants told U.S. District Judge James Boasberg in a filing.

    White House press secretary Karoline Leavitt said in a statement over the weekend that the order from the judge “had no lawful basis” and that the order was also issued after gang member illegal immigrants had already been removed from U.S. territory.

    “The Administration did not ’refuse to comply’ with a court order,” she said, adding later that “the written order and the Administration’s actions do not conflict.”

    Leavitt also said that judges do not have jurisdiction over the president’s usage of the Alien Enemies Act or the president’s conduct of foreign affairs.

    “A single judge in a single city cannot direct the movements of an aircraft … full of foreign alien terrorists who were physically expelled from U.S. soil,” she said.

    Under pressure by the media, Biden DOJ finally charged J6 agitator Ray Epps in Sept 2023. Despite conduct that resulted in felony charges for other J6ers, Epps pleaded guilty to a single low-level disorderly conduct offense.

    Biden DOJ recommended 6 months in prison–knowing he would never get it. Judge James Boasberg gave him 12 months’ probation while sympathizing with Epps. “While many defendants have been vilified in a way unique to Jan. 6, you seem to be the first to have suffered for what you didn’t do. You were hounded out of your home. You were hounded out of your town,” Boasberg said at sentencing. Boasberg also claimed Epps “had to live like a fugitive because of lies others spread.”

    Either Biden will say that he knows about each pardon, and if so, he will have to defend it, as will the Democratic Party, or he will say that he doesn’t know about a specific pardon, and maybe it would become null and void.
    As for Trump’s pardons, I bet you he could explain each one that he granted, so there is ZERO chance his would be voided or even become an issue.

    There is no downside on calling out the ridiculous numbers of pardons, and there is no downside to having the American public see the details about a lot of them, which they most likely did not hear about in December and January.

  67. I see both sides of the argument, Autopens are perfectly legal. They are also meant to be used when signing/authoring hundreds and f not thousands or more of the same documents daily (like the IRS refund checks noted above; those are auto signed by direction of the executive).

    Pardons are specific documents pertaining to specific individuals with details that go far beyond a simple tax refund. I don’t know what the answer is, but getting a firm opinion from SCOTUS (one way or the other) is never a bad thing, even if we don’t like the ruling, Certainly is far superior to nuance and gray areas.

    At this point, it’s probably necessary to remove any security clearances Boasberg has and investigate in-depth any financial ties he has to the foreign terrorist organizations at issue in this case.

    As the DOJ letter notes, Boasberg—who was deeply involved in the Russiagate conspiracy to overthrow Trump—certified a foreign terrorist organization as a class for the sole purpose of blocking military action against it, and did so within minutes and without any evidentiary hearings.
