This means they can continue to rinse and repeat this grift.

RE: KY Senate – Beshear has said in the past that he believes that the legislative action to control US Senate appointments is unconstitutional. He has not specificed, so far as I know, which Constitution makes that so i.e. Federal or State. A cursory review of Section 4 of Article I of the US Constitution as well as the 17th Amendment makes it clear that the State legislature still has overall authority with regards to the state’s US Senators, even if they don’t get to “chuse” them anymore. Section 4 provides for the legislature to set the election of US Senators (though Congress may pass laws to alter such regulations), while the 17th Amendment, while altering the method of selection to popular elections (a mistake, in my view), says the following;
“When vacancies happen in the representation of any State in the Senate, the executive authority of such State shall issue writs of election to fill such vacancies: Provided, That the legislature of any State may empower the executive thereof to make temporary appointments until the people fill the vacancies by election as the legislature may direct.”
That’s a pretty clear instruction that governors can issue writs of election, but the legislature is still in overall control as to whether a governor can make such appointments. Note that in Massachussetts, the legislature amended the governor’s power for this specific action when it was assumed that John Kerry would be vacating his seat for the Presidency, but Mitt Romney could have appointed a Republican to replace Kerry; they instead provided for a short term appointment and a prompt special election so that a Republican might theoretically hold the seat only for a few months at best.
Section 76 of the KY Constitution also weighs in broadly;
“He shall have the power, except as otherwise provided in this Constitution, to fill vacancies by granting commissions, which shall expire when such vacancies shall have been filled according to the provisions of this Constitution.”
To me, if the legislature has already amended the state constitution, then there is a privision, no? The question is whether it was an amendment or a separate law. Ultimately, though, Section 5 of Article I of the US Constitution would decide the matter;
“Each House shall be the Judge of the Elections, Returns and Qualifications of its own Members…”
If the Senate refuses to seat a Beshear appointment, that is that. Nothing the Dems can do until the state resolves the issue, or the US Congress acts IAW the Article I and 17th Amendment provisions.
