The Supreme Court has agreed to hear a case this fall on the question of whether ICE can detain illegal aliens detained in the interior of the country — more than 100 miles from the border — if those aliens snuck across the border and were never subject to “inspection” by border officials. Persons “seeking admission” must be detained pending resolution of their case status. The issue is whether someone who has entered and remained, and take not steps to begin the process of obtain lawful status is to be considered under a statute as still “seeking admission” by virtue of his/her remaining in the U.S. — sometimes for years or decades — and building a life here. Is an illegal alien present in the U.S. “seeking admission” merely by refusing to ever leave on his own?
