Leonie Brinkema — the single-most wacky Judge on the Eastern District of Virginia District Court has entered an Order re a briefing schedule on a “Weaponization Case” case WITHOUT setting forth any basis for finding that the plaintiff has standing or that she has jurisdiction to do anything. Now, at the very outset of a case a Court can presume standing and jurisdiction for the sole purpose of having briefing on the question of standing and jurisdiction. I suspect that is what will play out now. BUT, sometimes the lack of standing and jurisdiction are self-evident from the four corners of the complaint, and can be dismissed on the Court’s own order. That is what she should have done here. But welcome to Brinkema-World. Strap yourself in — it can be a wild ride.

I personally know an OWL (Old White Liberal) who is also an AWFUL (Aged White Female Urban Liberal). I think with the rubbish continuing to roll out on Platner, Collins will be able to win that seat. Paxton, however, has had most of the negative baggage already exposed by Cornyn’s ads in the primary. With his 28 pt. lead in that race it’s more optimistic that Texas will deliver him the seat, especially with the poor dem candidate who is running against him.

unfortunately the CA race for governor is seeing the top 2 slots having a surge for Becerra and Steyer. While Hilton is still very competitive, it appears undecided dems and independents are turning towards the same old dems. Election Day is this Tuesday and I hope this late trend is not predictive of the outcome.

Re: CA GOV, I will only say that the current polling showing two Dems taking the lead has a combined Dem lead electorate of about 63D-33R. Currently, the ballot returns are 46D-34R, D+12. Four years ago, around this time, it was D+28. The final numbers were more like D+20, and the GE was D+18. If we allow all Is to vote Dem, the electorate is very close to the samples we are seeing in the polls. IOW, not going to happen. I personally think it will round out close to D+15-18 tops.
Alas, I do think the window for a two R lockout has closed. However, the leading Republican will get more than 21%, so I don’t see him falling behind both leading Ds unless half the voters going to other Dems move exclusively and equally to Steyer and Becerra. I just don’t see that happening.
