The judges were not impressed with Nu York using a (not applicable) consumer financing statute to go after trump; whether Queenless Latasha had exceeded her statute; the fact that trump used financial statements that told companies to perform due diligence; no damages exist as the banks wanted to lend; no history of prior cases; and the amount of fine (sc decision timbs vs indiana- eight amendment – excess fines applies to state and local gubments).
