    Zzzzzz….

When did Tina actually have a “thought” of her own?

    Never? Thought so.

The only TRO I think was “right” is that contractors need to be paid for work done, and that blanket orders refusing to pay is not a “contract dispute”. I believe the administration is indeed paying the contractors as they should.

I didn’t agree with any of the other TRO’s, but the appropriate response is not to impeach judges you disagree with, or fail to obey the ruling, you appeal the ruling through the appropriate process. Or you change the law governing the power of district judges as is being discussed in Congress.

The 5-to-4 decision vacated a temporary restraining order that required the Department of Education to reinstate the canceled grant funding to California, Colorado, Illinois, Maryland, Massachusetts, New Jersey, New York and Wisconsin. The grants were first terminated in early February after the Education Department said the programs ran afoul of the president’s executive orders banning diversity, equity and inclusion programs. (This is one of at least two lawsuits challenging the teacher training grant cancellations.)

Justices behind the majority opinion say the district court lacked the jurisdiction under the Administrative Procedure Act to issue the temporary restraining order. They suggested that the U.S. Court of Federal Claims, which handles contract-related cases, would have been better suited.

Without digressing into the weeds on the merits of the decision and any weaknesses in either sides arguments, I’m just floored that this case made it this far. I think it’s an interesting commentary on what our Country has become, politically.

For example, the basic argument of this gang banger illegal alien is that he is a “refugee” that  is entitled to asylum because he belongs to a criminal gang subject to the ire of another criminal gang. That is an argument for what?  So , now,  Bugsy Moran wants asylum in Switzerland because Scarface is trying to kill him? I am forced to think of Christopher Guest’s line in Spinal Tap: “There is such a fine line between clever and stupid” But here we are. Welcome to modern day America where an argument like  that is the basis for a case that makes its way to the Supreme Court rather than being  dismissed outright in connection with the original asylum claim.

Tina, The text you posted doesn’t fully capture the basis for the rejection. Their point is that as far as the EU is concerned, excessive and ridiculous regulatory barriers are equally restrictive for American exports, preventing the sale of many of our goods in EU countries. None intended, Mike. I will say, I’m still trying to figure this board  out . Everyone seems so very nice, sincere and well meaning, except for  2 posters that have no problem regularly making personally insults and ad hominem attacks on everyone. What’s even more of a head scratcher to me is that one of them purports to be an attorney.  I know numerous outstanding attorneys and all chomp at the bit to exercise their skill at drafting a quick, respectful, well reasoned, and cogent argument to an opposing point of view. It’s in their DNA. They would never resort  to name calling and insulting anyone in connection with presenting their positions or defending them. Not with opposing counsel, friends on a message board, or even adversaries. However, that’s not the case here.
