  5. Chicon, its not about actually impeaching the judge. Its about showing how outrageous it is for a judge to step in and say, no a president cannot look at what his agencies are doing. The judge has made himself essentially a co-president.

  13. So should the SCOTUS justices who issued the Dobbs Decision be impeached when Democrats regain power? Should Judges be impeached every time they find a law passed by Congress and signed by the President unconstitutional? Very dangerous precedent and the kind of thing Democrats would do.

  14. The impeachment of judges is legit when they deliberately abuse their judicial authority by applying an unconstitutional ruling. Impeachment should never be used, however, if the ruling is constitutional but people want to punish a jurist for making a ruling they don’t like.

    Like

  15. And who decides what is unconstitutional? Gateway Pundit?

    Like

  16. This isn’t the same thing. It wasn’t the judges disagreeing with a law passed by congress. It wasn’t a decision over whether something is a state issue or federal issue. It was about a judge, who didn’t even let Trump’s lawyers in the building, announcing himself to essentially be co-president with Trump, saying that Trump cannot freely run the executive branch of government.

This is far, far worse than the 2005 Kelo decision which ruled that a local government can seize your property and boot you off of it, if they learn that a different owner of said property could pay them more in taxes. That was way beyond eminent domain.

The judge in the situation this week stepped in to say Trump cannot even look at what his own executive agencies are spending, nor put a stop to it. The action of this judge is one of the grossest violation of separation of powers I have ever witnessed.

And make no mistake, this judge was SHOPPED for, because the Dems knew the judge would fall on the sword for the cause.

  20. What if a judge ruled that Trump is not allowed to meet with his cabinet?

Or another judge who rules that Trump is not allowed to talk to any foreign leaders?

What if a judge rules that for the good of the country, Trump must off himself in 24 hours?

At what point do you agree that its okay to start articles of impeachment against a rogue judge?

I’d say when there is no colorable argument that the judge’s position is correct. Or if factors outside the cases – like a political desire to thwart Trump – were shown to be the primary determining factor in the ruling.

I don’t think either will be present in this case, but I’m willing to have Congress check into the case. As I’ve said before, the Dems have changed the rules of the game, and I’m not a fan of unilateral disarmament.

  38. Impeaching, or as it is in this case, threatening to impeach, which is all that would happen, is not lawfare. Lawfare involves the sort of stuff we have seen the last four years. What is going on here is a judge deciding by himself, without any appeal to precedent, or law or anything, that Trump cannot exercise his executive role. It is THIS JUDGE who is engaging in Lawfare, not the representative who called for his impeachment.

Under the Dredd Scott and Plessy v. Ferguson cases (1 pre and 1 post 13-15 Amendments) there was no colorable argument that segregation was illegal or unconstitutional. Was the Impeach Earl Warren crowd correct?

But because he has so outrageously violated separation of powers, and himself engaged in lawfare to stop Trump from exercising oversight of the executive branch, this judge should be threatened with impeachment.

Crane said in his threat to bring impeachment charges: “Partisan judges abusing their positions is a threat to democracy […] Judge Engelmayer is attempting to stop White House employees from accessing the very systems they oversee. They sat there for the last four years spewing out whatever Biden wanted them to say, ignoring the obvious questions any truly independent journalist might ask, but now they are crying foul because Trump kicked them out for their refusal to go along with the Gulf of America.

I think Trump is being a bit silly with the whole thing, but it does expose the hypocrisy of the AP for suddenly getting concerned about independence in journalism, after acting like Pravda the last four years.

  71. You always here people rage against Big Oil, Big Pharma, Big business in general. But you don’t hear those same people rage against BIG GOVERNMENT…that has become unquestionably bloated, unresponsive to the people who they were set up to serve, and go off and spend money allocated to them for X, Y, and Z and instead spend it on A, B, and C. These bureaucrats look on the public with disdain, and feel the bureaucrats know what is the best for the people and that the people are too stupid to know what is best for them. They say when the masses of Mayans got fed up with the bureaucracy, they rose up and killed them off. Wonder if such a scenario will play out in my lifetime.
