The term “chickened out” never applied to Reagan, that is the typical language of the Reagan haters. Whatever reason Reagan had for dealing or not dealing with an EO, “chickening out” was not one of them.

I don’t think Reagan would have succeeded in revoking EO11246. The Supreme Court was much more to the left in the 1980s and the ‘right-the-wrongs’ mentality was still dominant.
It is the recent focus on Equal Protection, ratified by our current Supreme Court, that has led to the demise of affirmative action.

I think that is another point about Reagan that Trump could learn from, Reagan was not inclined to engage in fights where he knew he couldn’t prevail.
Now I understand that Trump probably knew the EO would be quashed and he might just be hoping for a favorable SC decision, while Reagan was probably convinced the SC at that time would not have entertained it.
Nevertheless, in my view the odds of a favorable SC decision are very small.

Trump’s EO about birthright citizenship is unconstitutional–due to the way the 14th Amendment was written and interpreted over the years.
To CHANGE it to NOT give birthright citizenship to illegal aliens, tourists, foreign diplomats, space aliens from Mars who land here and then give birth to space aliens, etc., the U.S. would need to add and ratify an amendment to the amendment.

I was surprised that at no time did the judge bring up the argument of “what if” the situation were reversed and Person B and A switched positions and B sold couch to A who later found $10,000 in the couch that belonged to B. Would person B still insist that, well it is finders keepers and person A should keep the money and not give it back to B. You know, the old Biblical “Do unto others as you would have them do unto you…”)
(the further problem was that Person B had already spend a large chunk of his find on other things so really does not have $10,000 to hand over)
