I believe that Trump knows the EO will be overturned unanimously by the SC. There is no other way to read the amendment than to say, any person born on American soil is American, no matter the status of the parents. There is also this little thing called stare decisis, and this SC would be hard pressed to reverse a 100 year old precedent.
With that said, I think he did it to give his base fodder. A big chunk of red meat to salivate over while other things are going on. He, his cabinet, his lawyers, et al know he’s going to have it overturned…and fairly quickly I believe.
