Daniel Penny is now on trial for stepping forward when no one else would, in the midst of these threatening circumstances. This is exactly how the judicial system encourages onlookers to become more risk-aversive, instead of proactive in countering criminal acts of violence.

    The jury cannot move on to the lesser charge until they have a verdict on the manslaughter charge.

    The lesser charge, negligent homicide, only carries a maximum sentence of 4 years.

    I am relieved that at least he doesn’t face the 15 year maximum of the manslaughter charge.

  29. It is outrageous that Penny had a mistrial instead of an acquittal. NYC wants to stop self-defense by these prosecutions, even though they can’t officially do that by way of laws. It is a disgrace and is one reason I do not expect to ever visit there again unless these progressive loons are booted out of office and replaced by some law and order pols.

    NY was a mixed bag.

    Trump only lost by 12 vs 23 in 2020, cutting is deficit from 2 million votes to less than 1 million. He got 17% in Manhattan vs. 12% in 2020. 37% in Queens vs. 27% in 2020. 27% in the Bronx, vs. 15% in 2020!

    But Rs lost 3 house seats, 2 by very slim margins.

    The jury asked the judge to go over the “reasonable” standard again.

    That tells me perhaps there are only one or two hold outs for conviction on manslaughter and the rest of the jury wanted them to understand what Penny did was “reasonable”.

    Someone on Redstate thinks that may be the case too.

    This person also reported one juror shook his head when the judge said to keep trying to reach a verdict.

    What is interesting is you would think the cultists and “true conservatives” would be happy that Trump won, the disastrous prospect of a Harris Presidency was averted, along with all the negative consequences for conservatives that would have ensued.

    Instead, they are the same angry, miserable people they were before the election. Instead of celebrating the win, they immediately went back to the divisive attacks on perceived and imaginary RINOS, bitterly upset that maybe out of 30 cabinet appointments, the senate might reject one or two of them. All “dissenters” are attacked as RINO traitors and “Democrats”.

    It’s all about absolute 100% litmus tested loyalty to Trump. Nothing else can be tolerated or discussed.

  74. Vic – I have had players go on to high school teams. One year, I had a softball team of players from 7th to 11th grade. One of my favorite seasons. One game I had 2 sisters fighting in the dugout because the 10th grader was teasing the 8th grader over a boy. Her mom asked if it was a problem. I said as long as they kept hitting the ball I could live with it.

    One basketball season, my team was 2-10 entering the playoffs. 8-11 grade. Took out the 3, 2, and 1 seeds to win it all.

    I would give up law to coach but I know my level. I could not cut a player. If they just want to play their best, even if their best is not great, they have a place on my team.

    So many years we haven’t had the best players, but won the championship or made it that far because good teams who play together can beat better teams with superstars who don’t
